JUSTICE NARENDRA NATH TIWARI ----- For the Petitioner - Mr. J.S.Singh For the State - Mr. A.P.P ----- 2/17.8.2013 The petitioner is in custody in connection with the case registered under Sections 302/34 IPC and Section 27 of the Arms Act. Learned counsel for the petitioner submitted that though the petitioner and two other persons have been named in the FIR, only suspicion has been raised in the allegation made in the FIR; there is no eye-witness to the occurrence; nothing incriminating has been recovered from the petitioner's possession; the petitioner has not been put on T. I Parade; co-accused Ravi Ganjhu and Arjun Ganghu with almost similar allegations have been granted bail by this Court in B. A. Nos. 1449/2013 and 1519/2013 respectively; the petitioner is in custody since April 2013; the petitioner is a local permanent resident and there is no chance of his absconding. Learned A.P.P opposed the petitioner's prayer for bail. However, he has not disputed the said factual contentions submitted by learned counsel for the petitioner. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Latehar in connection with Balumath P.
