.....the petitioner submits that for an occurrence whereby certain miscreants robbed off the belongings of the driver, a case was registered against unknown. during investigation, one bimal das was arrested, who confessed his guilt and also disclosed about the complicity of the petitioner in the alleged offence but save and except the confession made by the co-accused, no evidence is there against the petitioner relating to complicity of the petitioner in the alleged offence. regard being had to the facts and circumstances of the case, the petitioner is directed to be enlarged on bail on furnishing bail bond of rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of additional chief judicial magistrate, bermo at tenughat in bermo p.s. case no.73 of 2013 (g.r.no.444 of 2013). Heard learned counsel appearing for the petitioner and learned counsel appearing for the State. The petitioner is an accused in Bermo P.S. case no.73 of 2013 registered under section 395 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that for an occurrence whereby certain miscreants robbed off the belongings of the driver, a case was registered against unknown. During investigation, one Bimal Das was arrested, who confessed his guilt and also disclosed about the complicity of the petitioner in the alleged offence but save and except the confession made by the co-accused, no evidence is there against the petitioner relating to complicity of the petitioner in the alleged offence. Regard being had to the facts and circumstances of the case, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bermo at Tenughat in Bermo P.S. case no.73 of 2013 (G.R.No.444 of 2013).
