NO. 16112 OF 201.---------------------------------------- Dated this the 03rd day of July, 2013 JUDGMENT The petitioner is operating a stage carriage with vehicle No. KL-07/BF 921.on a regular permit from Gothuruth to Munambam. In respect of sector Munambam to Cherai the time slot granted is only 14 minutes whereas according to the petitioner other similar services are given the time slot of 17 minutes. Hence, he submitted Ext. P1 and P2 representations for rectifying the said anomaly which according to the petitioner is not considered so far.

The learned Government Pleader takes notice on behalf of respondent and on instructions would submit that this disparity had occurred on account of the fact that in the same timing, two claimants were permitted to operate in the same route and therefore one of them was asked to complete the service in that sector within a shorter time. Having regard to the aforesaid situation, I am of the that that it may not be proper to permit one operator to travel at a lesser time period with reference to the other operators. However, this is matter to be considered by the Transport Authorities after getting reports from the concerned field officer.
4. Having regard to the aforesaid situation, I am of the view that this writ petition can be disposed of as follows:- The respondent shall consider Ext. P1 and P2 representation and shall make appropriate arrangements for regularising the time slot in respect of the petitioner and other similar operators after hearing the affected parties within a period of two months from the date of receipt of copy of judgment.
