1. ThisappealhasbeenAdmittedvideorderdated24 thJune,2013and therecordandproceedingsofSessionsTrialNo.506of1993wascalled fromthetrialcourtsoastoappreciatetheargumentsforsuspensionof sentence.ThisCourthasreceivedtherecordandproceedingsofthetrial courtandwehaveperusedthesame.
2. Havingheardcounselforboththesidesandlookingtotheevidences onrecord,itappearsthatthereisaprimafaciecaseinfavourofthese appellants.Asthecriminalappealispending,wearenotmuchanalyzing theevidencesonrecord,but,sufficeittosaythatlookingtothedeposition givenbytheprosecutionwitnessesfromP.W.2toP.W.10,thereisaprima faciecaseinfavouroftheseappellants.

Wetherefore,suspendthesentenceawardedbythetrialcourttothe presentappellants.Duringpendencyofthisappeal,theappellantsnamely, (i)Karma@KaramdeoKarmali(ii)PaloDeviand(iii)AmritKarmali,are directedtobereleasedonbailuponexecutingbondofRs.10,000/(Rs.ten thousand) each, with two sureties of the like amount each, to the satisfactionoftheAdditionalSessionsJudgeVI,Hazaribagh,inconnection withSessionsTrialNo.506of1993,ontheconditionthattheseappellants shallbeavailableasandwhentheirpresencearerequiredbythecourt.
