No.5318 of 2013: /13.8.2013: In this interlocutory application, the appellant, above named, has prayed for his release on bail during pendency of the appeal. Learned counsel for the appellant submitted that though his same prayer was earlier rejected, co-convict Awadh Kishore Sahu has been granted bail by this Court vide order dated 18.2.2010 in Cr. Appeal (DB) No. 1383 of 2004 [IA (Cr.) No. 405 of 2010]; the appellant's case stands on better footing than that of said co-convict; the appellant has been convicted on the basis of confessional statement of the said co-convict-Awadh Kishore Sahu; he has remained in custody for more than twelve years. Learned A.P.P. opposed the appellant's prayer for bail, but has not disputed the said contentions. Regard being had to the facts and circumstances, the appellant , namely, Ajay Kumar Gupta @ Chhotu @ Ajay Soni is directed to be released on bail, during pendency of the appeal, on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Judicial Commissioner, Ranchi in Sessions Trial No. 12/2001.
