Petitioner Versus The State of Jharkhand & others......Respondents. ----- CORAM: HONBLEMR.JUSTICEAPARESHKUMARSINGH ForthePetitioner :Mr.SumeetGadodia,Adv. FortheRespondents :Mr.RanganMukhopadhyay,Adv. ----- 2/13.8.2013 Heard learned counsel for the parties. The petitioner is said to have retired as a Pump Khalasi on 30th September, 2012 from the office of respondent no. 5, Executive Engineer, Drinking Water & Sanitation Division, Gumla. According to him, post retirement dues such as Pension, Gratuity, Earned Leave amount of 300 days have not been paid to him. He has also not been given the benefit of revised salary in terms of A.C.P and M.A.C.P granted in February, 2010. He also seeks a direction upon the respondents to pay the difference of salary pursuant to 5th Pay Revision w.e.f. 1st January, 1996. According to him, he has made representation vide Annexure-5 to the respondent no. 5, Executive Engineer, Drinking Water & Sanitation Division, Gumla, but the matter is still not finally redressed. Learned counsel for the respondents submits that if the petitioner approaches the respondent no. 5, Executive Engineer, Drinking Water & Sanitation Division, Gumla with a fresh representation, the same shall be considered in accordance with law after proper verification of the service records for redressal of his aforesaid grievance in relation to post retirement dues and other arrears of salary. In such circumstances, without commenting upon the merits of the case, the writ petition is disposed of with a liberty to the petitioner to approach the respondent no.5, Executive Engineer, Drinking Water & Sanitation Division, Gumla with a fresh representation together with all supporting facts and documents within a period of 3 weeks .
