05. 13.08.2013 By way of instant interlocutory application, petitioner prays for early hearing of the matter. The grievance of the petitioner in that his post retirement benefits are not being paid though he has retired from service under respondent- Hazaribag Mines Board on 31.7.2005. However, it appears that there is no counsel appearing on behalf of Mines Board. In that view of the matter, let the Urban Development Department, Government of Jharkhand through its Principal Secretary be impleaded as party- respondent for which necessary correction shall be made by the counsel for the petitioner in red ink at the relevant place in the main writ application during the course of the day. Let the copy of the instant writ application be served upon the J.C. to learned A.A.G., Mr. Jai Prakash, who accept notice on behalf of the newly added respondents. I.A. No. 5477 of 2013 stands disposed of. W.P.(S). No. 3440 of 2011 Issue notice upon respondent no. 1 and 2 under registered cover with A/d for which requisites etc. must be filed within 1 week, failing which, this application shall stand rejected without further reference to the Bench. Learned counsel for the petitioner submits that earlier twice attempt made to serve notice upon the respondent no.1 and 2 have failed. However, he is allowed to effect service upon learned counsel, Mr. Prashant Pallav, who usually appears on behalf of the Hazaribag Mines Board. In such circumstance, if Mr. Prashant Pallav, learned counsel appearing on behalf of the Mines Board accept notices on behalf of the respondent no.1 and 2 and -2- a receipt to that effect is filed in the office within one week, then issuance of notice upon the said respondents shall be waived.
