Judgment:
IN THE HIGH COURT OF JHARKHAND AT RANCHI Cr. Appeal (D.B) No. 467 of 2006 Santosh Mahto & Others .. Appellants Versus The State of Jharkhand .. Respondent ----- CORAM HONBLE MR. JUSTICE NARENDRA NATH TIWARI HONBLE MR. JUSTICE P. P. BHATT ----- For the Appellant No.2 - Mr. Randhir Singh For the State - Mr. A.P.P ----- 7/12.8.2013 I. A. (Cr.) No. 2687/2010 In this application, the appellant No.2, namely, Youdhisthir Mahto has prayed for his release on bail, during pendency of this appeal. Learned counsel for the appellant No.2 submitted that though the prayer for bail of the appellant No.2 was earlier rejected by this Court, he has remained in custody for more than seven years; there was omnibus allegation of assault against four persons; two of them i.e. appellant Nos.1 & 3 have already been granted bail; there is no likelihood of the appeal being taken up for hearing in near future. Learned A.P.P opposed the prayer for bail of the appellant No.2, but has not disputed the said contentions based on record. Regard being had to the long period of custody, during pendency of this appeal, the above named appellant No.2 is directed to be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, F.T.C-II, Seraikella - Kharsawan in connection with S. T. No. 27/2004. This application stands disposed of. (NARENDRA NATH TIWARI, J) S.K (P. P. BHATT, J)
