THE MAHARASHTRA HOUSING AND AREA DEVELOPMENT ACT, 1976 THE MAHARASHTRA HOUSING AND AREA DEVELOPMENT ACT, 1976 An Act to unify, consolidate and amend the laws relating to housing, repairing and reconstructing dangerous building and carrying out improvement works in slum areas. 1[WHEREAS, on account of the rapid growth of industries in the urban areas and the fast growth of population and commercial activities in such area, the need of housing accommodation could not be met by the limited house construction activities in the private sector; AND WHEREAS, in the urban areas and particularly in the 2[Brihan Mumbai] the old buildings which have outlived their lives and rendered themselves in a bad state of repairs and presented a dangerous possibility of collapse, necessity was increasingly felt to take up the programme of repairs and reconstructions of such buildings; AND WHEREAS, due to acute shortage of accommodation in the urban area such have come up which necessitated taking up improvement works in slum areas; AND WHEREAS, the magnitude of the housing programme for construction of new houses throughout the State and the task of repairs and reconstruction of old and.....

.....in the case of services and posts in connection with the affairs of the Union and of the State respectively, it was not considered necessary to enact the Act, referred to above. 2. In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, the Governor of the Punjab issued the rules as contained in the First Edition and reprint thereof. Since the issue of the First Edition (reprint)m there have been several changes in the Leave Rules any Pay Fixation Rules, and enhanced powers have been delegated to the various authorities during 1962. The present edition incorporates correction slips Nos.1 to 222, amendments Nos. 1 to 30 of 1962 and 1 to 26 of 1963 to the First Edition (reprint), and thus brings the compilation up-to-date. 3. From Ist November 1956, the erstwhile State of Pepsu and Punjab have been integrated into the new State called Punjab. Under proviso to Section 115 (7) of the States Re-organisation Act, 1956, no rule can be amended or made, which would adversely affect the conditions of service of the employees of the erstwhile States of Punjab and Pepsu, except with the specific approval of the Government of India. Shops and Commercial Establishments Act, 1961 Chapter 3

.....be computed; (b) the registers that shall be maintained in an establishment for the purpose of securing compliance with the provisions of this section. Section 9 - Interval for rest The periods of work of an employee in an establishment each day shall be so fixed that no period shall exceed five hours and that no such person shall work for more than five hours before he has had an interval of rest of at least one hour. Section 10 - Spread over The periods of work of an employee in an establishment shall be so fixed that, inclusive of his interval for rest, they shall not spreadover more than twelve hours in any day. Section 11 - Opening and closing hours (1) No establishment shall on any day, be opened earlier than and closed later than such hours as may be fixed by a notification issued by the State Government: Provided that any customer who was being served or was waiting to be served in any establishment at the hour fixed for its closing may be served during the quarter of an hour immediately following such hour. .....become due and payable, (3) For the removal of doubts, it is hereby declared that-- (a) save as otherwise expressly provided in this section or in any other section of this Act, no liability, other than the liability specified in sub-section (2), of the Amritsar Sugar Wills Company in relation to the Amritsar Oil Works in respect of a period prior to the appointed day shall be enforceable against the Central Government or the Government Company, as the case may be; (b) no award, decree or order of any court, tribunal or other authority in relation to the Amritsar Oil Works, passed after the appointed day, in respect of any matter, claim or dispute in relation to any matter, not being a matter referred to in sub-section (2), which arose before that date shall be enforceable against the Central Government or the Government company, as the case may be; (c) no liability incurred by the Amritsar Sugar Mills Company before the appointed day, for the contravention, in relation to the Amritsar Oil Works, of any provision of law for the time being in force, shall be enforceable against the Central Government or the Government company, as the case may be.
