THE KERALA FISHERMEN DEBT RELIEF COMMISSION ACT, 2008 ACT 18 OF 2008 THE KERALA FISHERMEN DEBT RELIEF COMMISSION ACT, 2008 An Act to provide for urgent relief to the fishermen who are in distress due to indebtedness, by constituting a Commission for recommending relief measures to such fishermen and for solving their problems through conciliation, negotiation and adjudication and for matters connected therewith or incidental thereto; Preamble.-WHEREAS, majority of the traditional fishermen, earning livelihood by fishing in sea and in inland waters, are now entrapped in great indebtedness; AND WHEREAS, loan was obtained in large scale from various agencies, banks and individuals for the purchase of fishing equipments and the situation of inability to repay the debt exist for years due to disgust in production, fall in price and unemployment and exploitation by intermediaries and the liability of debt has been accruing; AND WHEREAS, the liability of fishermen is increasing due to natural calamities, sea erosion, Tsunami and the ruins due to monsoon etc., occurring again and again the loss of work and the losses caused to the fishing equipments etc; AND WHEREAS, they are.....

Preamble - WHEREAS, the benefits conferred by the Kerala Agricultural Debtors' (Temporary Relief) Act, 2001 (Act 19 of 2001) are available only in respect of debts incurred by farmers before the 29th December 2001, on which date the said Act came into force; AND WHEREAS, even after the said date the farmer indebtedness in the State continued to be on the increase due to various factors; AND WHEREAS, certain districts in the State are afflicted by severe distress due to the agrarian crisis, and it ruined many farmers financially and in some cases led to suicide; AND WHEREAS, several suits and other proceedings have been filed in courts, tribunals and other authorities for the recovery of debts accrued from farmers; AND WHEREAS, it is expedient to provide relief to the farmers who are in distress due to indebtedness, by constituting a Commission with power to pass awards after adjudication and recommend appropriate measures for the redressal of the grievances of such farmers through conciliation and negotiation and for matters connected there with or incidental thereto; BE it enacted in the Fifty-seventh year of the.....

.....before the commencement of this Act or filing thereafter, for the prosecution of such agriculturist under section 138 of the Negotiable Instrument Act, 1881 (Central Act 26 of 1881) if the agriculturist files an application in such court raising the contention that the debt is one coming under the purview of this Act. 4. Payment of debt in instalments.--(1) Notwithstanding anything contained in any law or contract or in any decree or order of any court or tribunal, an agriculturist may discharge his debts in the manner specified in sub-section (2) and in sub-section (3). (2) If any debt is repaid in thirty monthly instalments together with interest at the rate specified in section 5, on the principal amount outstanding at the time of each payment, the whole debt shall be deemed to be discharged. (3) The first instalment of any debt payable under sub-section (2) other than a debt payable to a co-operative society shall be paid before the expiry of a period of twelve months from the commencement of this Act and first instalment of any debt due to a co-operative society shall be paid before the expiry of six months from such commencement and each of the remaining instalments.....

.....defined and brought within the ambit of regulation, a large part of the buying and selling of agricultural produce may evade the operation of the Act. The Act oriented towards controlling the owners of markets; the primary duty of running the markets is Imposed upon the owners of the market: the market committee or the State Government may not intervene except in the event of formal failure on the part of the owners. If the present owners abide by the fair rents, undertake to check specified malpractices, provide for certain sanitary arrangements and maintain the markets as they are. such markets have to be left in their charge. The owners do not have any obligation to develop the markets and will have no incentive nor will they have resources enough for Investment for new development. Title: Power of Credit Institutions to Vary Certain Agreements

Notwithstanding anything contained in any agreement under which any term loan has been sanctioned by the credit institution before the 1st day of October, 1991, it shall be lawful for the credit institution to vary the agreement, so as to increase the rate of interest stipulated therein to the extent to which such institution is liable to pay the interest-tax under this Act in relation to the amount of interest on the term loan which is due to the credit institution. Explanation.-- For the purposes of this section, "term loan" means a loan which is not repayable on demand.'.
