Partition Act, 1893 Section 6

Title: Reserved Bidding and Bidding by Shareholders

(1) Every sale under section 2 shall be subject to a reserved bidding, and the amount of such bidding shall be fixed by the court in such manner as it may think fit and may be varied from time to time. (2) On any such sale any of the shareholders shall be at liberty to bid at the sale on such terms as to non-payment of deposit or as to setting off or accounting for the purchase-money or any part thereof instead of paying the same as to the court may seem reasonable. (3) If two or more persons, of whom one is a shareholder in the property, respectively advance the same sum at any bidding at such sale, such bidding shall be deemed to be the bidding of the shareholder.

Whoever, at any sale of property held by the lawful authority of a public servant, as such, purchases or bids for any properly on account of any person, whether himself or any other, whom he knows to be under a legal incapacity to purchase that properly at that sale, or bids for such property not intending to perform the obligations under which he lays himself by such bidding, shall be punished with imprisonment of either description for a term which may extend to one month, or with fine which may extend to two hundred rupees, or with both.

Indian Penal Code (45 of 1860) Section 169

Title: Public Servant Unlawfully Buying or Bidding for Property

Whoever, being a public servant, and being legally bound as such public servant, not to purchase or bid for certain property, purchases or bids for that property, either in his own name or in the name of another, or jointly, or in shares with others, shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both; and the property, if purchased, shall be confiscated.

Karnataka Municipalities Act, 1964 Section 371

(1) No employee of a municipal council, or any officer having any duty to perform in connection with the sale of movable or immovable property under this Act shall directly or indirectly bid for or acquire interest in any property sold at such sale. (2) Any person who contravenes the provisions of sub-section (1), shall, be punished with fine which may extend to five hundred rupees and shall also be liable to dismissal from service.
