Karnataka Panchayat Raj Act, 1993 Section 156

Title: Functions of the Executive Officer and Other Officers and Officials

.....the Taluk Panchayat or the committee or the Adhyaksha in the form of a written note containing the reasons for his opinion and specifying the law, rule, order, regulation or provision with which the proposal or resolution or order is inconsistent and if the proposal or resolution or order has been considered and passed by the Taluk Panchayat or the committee or the Adhyaksha before such advise is tendered, the Executive Officer may resubmit the proposal or resolution or order with his advice after such examination as he considers necessary.] 4 [(3) If the Taluk Panchayat or any of its committees or the Adhyaksha passes the resolution or order without resolving the inconsistency referred to in sub-section (2) it shall be the duty of the Executive Officer, not withstanding any other provisions in this Act, to forward forthwith to the Chief Executive Officer under intimation to the Adhyaksha a copy of the said resolution or order along with his written note.] _______________ 1. Title: Functions of the Chief Executive Officer and Other Officer

.....Zilla Parishad in matters of financial policy and shall be responsible for all matters relating to the accounts of the Zilla Parishad including preparation of accounts and the budget. (4) The Chief Accounts Officer shall ensure that no expenditure is incurred except under proper sanction and in accordance with this Act and the rules and regulations made thereunder and shall disallow any expenditure not warranted by the Act or rules and regulations or for which no provision is made in the budget. (5) The Additional Chief Executive Officer shall assist the Chief Executive Officer in the performance of his duties. (6) The Chief Planning Officer shall advise the Zilla Parishad in matters of plan formulation and shall be responsible for all matters relating to planning of the Zilla Parishad including the preparation of plans of economic development and social justice and annual plan of the district.

.....III relates to the areas in which the State Government has merely ordered suspension or remission of land revenue. In both cases, however, under Sections 1(3) and (4) of the Act, it is the State Government which has to specify the date by notification in the Official Gazette from which Part II or III, as the case may be, shall come into force in any area and to specify the date by like notification from which the relevant Part shall cease to be in force in that area. So far, these powers of the State Government were delegated to the Commissioners under Section 3(4) of the Bombay Commissioners of Divisions Act, 1957. But to save correspondence between the Commissioner and the Collectors and consequent delay and as the work relating to suspension or remission of the land revenue is being done by the Collectors, the Divisional Commissioners, in their Conference held in November, 1975, have recommended that these powers may be delegated to the Collectors directly. The Act implements this recommendation, by suitably amending Sections 1(3) and (4) of the Execution of Decrees (Temporary Postponement) Act, 1959.- vide Statement of Objects and Reasons-Maharashtra XII of 1979. .....

Title: Functions Exercisable by Judicial and Executive Magistrates

State: Central

Where under any law the functions exercisable by a Magistrate relate to matters which involve the application or sifting of evidence or the formulation of any decision which exposes any person to any punishment, or penalty, or detention in custody pending investigation, inquiry or trial or would have the effect of sending him for trial before any Court, such functions shall, subject to the provisions of this Act and the Code of Criminal Procedure, 1898, as amended by this Act, be exercisable by a Judicial Magistrate and where such functions relate to matters which are administrative or executive in nature, such as the grant of a licence, the suspension or cancellation of a licence, sanctioning a prosecution, or withdrawing from a prosecution, they shall, subject as aforesaid, be exercisable by an Executive Magistrate.
