Sale of Goods Act, 1930 Section 61

Title: Interest by Way of Damages and Special Damages

(1) Nothing in this Act shall affect the right of the seller or the buyer to recover interest or special damages in any case where by law interest or special damages may be recoverable, or to recover the money paid where the consideration for the payment of it has failed. (2) In the absence of a contract to the contrary, the court may award interest at such rate as it thinks fit on the amount of the price-- (a) to the seller in a suit by him for the amount of the price--from the date of the tender of the goods or from the date on which the price was payable; (b) to the buyer in a suit by him for the refund of the price in a case of a breach of the contract on the part of the seller--from the date on which the payment was made.

.....liable for any nuclear damage where such damage is caused by a nuclear incident directly due to- (i) a grave natural disaster of an exceptional character; or (ii) an act of armed conflict, hostility, civil war, insurrection or terrorism. (2) An operator shall not be liable for any nuclear damage caused to-(i) the nuclear installation itself and any other nuclear installation including a nuclear installation under construction, on the site where such installation is located; and (ii) to any property on the same site which is used or to be used in connection with any such installation; or(iii) to the means of transport upon which the nuclear material involved was carried at the time of nuclear incident: Provided that any compensation liable to be paid by an operator for a nuclear damage shall not have the effect of reducing the amount of his liability in respect of any other claim for damage under any other law for the time being in force.(3) Where any nuclear damage is suffered by a person on account of his own negligence or from his own acts of commission or omission, the operator shall not be liable to such person. 6. Title: Amount of Compensation to Be Payable in Transferable Bonds

The amount of compensation payable under the provisions of this Act shall be payable in transferable bonds carrying interest at the rate of four per cent. per annum from the date of the issue of such bonds, and shall be repayable during a period of twenty years from the date of the issue of such bonds by equated annual installments of principal and interest. The bonds shall be of such denominations and shall be in such forms as may be prescribed. NOTES Under the existing section 17 of the Bombay City (Inami and Special Tenures) Abolition and Maharashtra Land Revenue Code (Amendment) Act, 1969 the amount of compensation is payable in transferable bonds repayable by twenty equated annual installments of principal and interest. However, since the number of claims for such compensation are very few and the amount of compensation to be paid is not very large, it is considered expedient to amend section 17 of the said Act suitably to provide that the amount of compensation shall be paid in cash and either in lump sum or in equal installments not exceeding twenty.- Statement of Objects and Reasons.
