Amendment of section 4.-- In section 4 of the principal Act, in sub-section (1), -- (a) in clause (c), in sub-clause (ii), for the words "at the rate of eight rupees per kilometre", the words "at the rate of thirteen rupees per kilometre" shall be substituted; (b) after the second proviso, and before the Explanation, the following proviso shall be inserted, namely: -- "Provided also that the rate specified in sub-clause (ii) of clause (c) of this sub-section shall be applicable for a period of five years from the date of commencement of the Salary, Allowances and Pension of Members of Parliament (Amendment) Act, 2006."; (c) in sub-section (2), after the second proviso, the following proviso shall be inserted, namely:-- "Provided also that the first proviso shall not be applicable to a member who, in the opinion of the Chairman of the Council of States or, as the case may be, the Speaker of the House of the People, is so incapacitated physically and cannot travel by air or train.". 4. The custodian shall have all the powers vested in a civil court under the Code of Civil Procedure, 1908 (Act V of 1908), when trying a suit, in respect of the following matters, namely:- (a) discovery and inspection; (b) enforcing the attendance or witnesses and requiring the deposit of their expenses; (c) compelling the production of documents; (d) examining witnesses on oath; (e) reception of evidence of on affidavits; (f) issuing commissions for the examination of witnesses; and may summon and examine suo motu any person whose evidence appears to him to be material; and shall be deemed to be a civil court within the meaning of section 480 and section 482 of the Code of Criminal Procedure; 1898 (Act V of 1898). Explanation.- For the purpose of enforcing the attendance of witnesses, the local limits of the jurisdiction of the custodian shall be the local limits for which he is appointed.

Be it enacted by Parliament as follows :- Act extended to Sikkim with modifications w.e.f. 1-11-89 - See Gaz. of Ind., 20-10-88 and 26-10-89, Pt. II, S. 3(ii), Ext., p. 3 (No. 533) and p. 2 (No. 691). The Act has been extended to the Union territory of- (1) Dadra and Nagar Haveli by Regn. 6 of 1963 (1-7-1965); (2) Pondicherry by Regn. 7 of 1963 (1-10-1963); and (3) Goa, Daman and Diu by Regn. 11 of 1963 (1-7-1965). (Goa is now a State). SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be calledthe Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954-. SECTION 03: APPOINTMENT OF CUSTODIAN AND ASSISTANT CUSTODIANS OF DEPOSITS (1) The Central Government may, by notification in the Official Gazette, appoint a Custodian of Deposits and as many Assistant Custodians of Deposits as may be necessary for the purpose of discharging the duties imposed upon the Custodian and Assistant Custodians by or under this Act. (2) Subject to the provisions of this Act, the Custodian and Assistant Custodians of deposits shall discharge the duties imposed on them by or under this Act under the general superintendence and control of the Central Government, and the Central Government may, by general or special order, provide for the distribution of work among them.
