1[16. Security procedures and practices.-- The Central Government may, for the purposes of sections 14 and 15, prescribe the security procedures and practices: Provided that in prescribing such security procedures and practices, the Central Government shall have regard to the commercial circumstances, nature of transactions and such other related factors as it may consider appropriate.'.] ______________________ 1. Substituted vide Information Technology (Amendment) Act, 2008 Prior to substitution text read as under :- The Central Government shall, for the purposes of this Act, prescribe the security procedure having regard to commercial circumstances prevailing at the time when the procedure was used, including-- (a) the nature of the transaction; (b) the level of sophistication of the parties with reference to their technological capacity; (c) the volume of similar transactions engaged in by other parties; (d) the availability of alternatives offered to but rejected by any party; (e) the cost of alternative procedures; and (f) the procedures in general use for similar types of transactions or communications.

Be it enacted by Parliament in the Fiftieth Year of the Republic of India as follows: - Chapter I Preliminary 1. Short title This Act may be called the Securities Laws (Second Amendment) Act, 1999. Chapter II Amendments To The Securities Contracts (Regulation) Act, 1956 2. Amendment of Section 2 In section 2 of the Securities Contracts (Regulation) Act, 1956 (42 of 1956) (hereafter in this Chapter referred to as the principal Act), after clause (g), the following clause shall be inserted, namely: -- '(ga) "Securities Appellate Tribunal" means a Securities Appellate Tribunal established under sub-section (1) of section 15K of the Securities and Exchange Board of India Act, 1992 (15 of 1992);'. 3. Insertion of new section 2A After section 2 of the principal Act, the following section shall be inserted, namely:-- "2A. Title: Security for Keeping the Peace and for Good Behaviour

.....sub-section (1) are (a) any offence punishable under Chapter VIII of the Indian Penal Code (45 of 1860), other than an offence, punishable under section 153A or section 153B or section 154 thereof; (b) any offence which consists of, or includes, assault or using criminal force or committing mischief; (c) any offence of criminal intimidation; (d) any other offence which caused, or was intended or known to be likely to cause, a breach of the peace. (3) If the conviction is set aside on appeal or otherwise, the bond so executed shall become void. Be it enacted by Parliament in the Fifty Fifth year of Republic of India as follows:- CHAPTER I PRELIMINARY 1. Short title and commencement (1) This Act may be called the Securities Laws (Amendment) Act, 2004. (2) It shall come be deemed to have come into force on the 12th day of October, 2004. CHAPTER II AMENDMENTS TO THE SECURITIES CONTRACTS (REGULATION) ACT, 1956 2. .....the Code of Civil Procedure, 1908 (5 of 1908), but shall be guided by the principles of natural justice and, subject to the other provisions of this Act and of any rules, the Securities Appellate Tribunal shall have powers to regulate their own, procedure including the places at which they shall have their sittings.
