THE CENTRAL INDUSTRIAL SECURITY FORCE ACT, 1968 [Act, No. 50 of 1968 ] [ 2 nd December, 1968 ] PREAMBLE 1[An Act to provide for the constitution and regulation of an armed force of the Union for the better protection and security of industrial undertakings owned by the Central Government, certain other industrial undertakings, employees of all such undertakings and to provide technical consultancy services to industrial establishments in the private sector and for matters connected therewith.] BE it enacted by Parliament in the Nineteenth Year of the Republic of India as follows:-- ________________________ 1 . Substituted by the Industrial Security Force (Amendment and validation) Act, 1999 w.e.f. 29-12-1999 prior to substitution it reader as under: "An Act, to provide for the contitution and regulation of an armed force of the Union fo r the better protection and security of industraial undertakings owned by the central Goverment and certain other industrial undertaking and the employees of all such industrial undertakings and for matters connected therewith"

.....the Central or State Government or any industrial undertaking in public sector;] (h) "scheduled industry" means any industry engaged in the manufacture or production of the articles mentioned in the First Schedule to the Industries (Development and Regulation) Act, 1951; 5[(ha) "subordinate officer" means a person appointed to the Force as an Inspector, a Sub-Inspector or an Assistant Sub-inspector;] (i) "supervisory officer" means any of the officers appointed under section 4 and includes any other officer appointed by the Central Government as a supervisory officer of the Force; 5[(j) "under officer" means a person appointed to the Force as a Head Constable, Naik or Lance Naik.] 6[(2) Any reference in this Act to a law which is not in force in any area shall, in elation to that area, be construed as a reference to the corresponding law, if any, in force in that area.] ________________________ 1. Title: Technical Consultancy Service to Industrial Establishments

1[14 A. Technical Consultancy Service to industrial establishments ( 1 ) Sub ject to any general directions which may be issued by the Central Government, it sh all be lawful for the Director-General, on a request received from the Managing Director of an industrial establishment in the private sector or any other person authorised by hi m in this behalf, to direct the me mbers of the Force to provide technical consultancy services relating to security, to such industrial establishments in such manner and on payment of such fee as may be prescribed. ( 2 ) The fee rece ived under sub -section ( 1 ) sh all be credited to the Consolidated Fund of India. Explanation.-- For the purposes of this section, the expression "Managing Director", in relation to an industrial establishment, me ans the person (whether called General Manager, Manager, Chief Executive Officer or a partner of a firm or by any other name) who exercises control over the affairs of the establishment.] _____________________________ 1 . .....agree to be relevant within one month from the commencement of this Act, or in default of such agreement which the authority referred to in sub-section (2) of section 3 may determine to be the relevant record. The Ganga and Ghaghra rivers and their high banks wherever mentioned in this Schedule have reference to the geographical river or high bank positions, as the case may be, as shown in the survey records mentioned in the foregoing paragraph. Ganga Sector 1. The boundary in this sector shall commence from a point (approximate Latitude 25 44' 10", Longitude 84 36' 06") on the existing fixed boundary between Bihar and Uttar Pradesh, lying between Shitab Diara (Bihar), Mahazi Kondarha (Uttar Pradesh) and Khawaspur (till now in Uttar Pradesh) and located about half mile roughly south west of the present "abadi" site of Babudera village (near Daljitoia). Accordingly, the portion of the present alignment of the above mentioned existing fixed boundary between this point and the present Ganga river wilt cease to be the boundary between the States of Bihar and Uttar Pradesh. 2. SECTION 14: ARREARS OF TAXES - The right of Bihar or Uttar Pradesh to recover arrears of any tax or duty on property situate in the transferred territories, including land revenue, or to recover arrears of any other tax or duty in any case where the place of assessment of that tax or duty is in the transferred territories shall belong to the State to which the territories are transferred. SECTION 15: RIGHT TO RECOVER LOANS AND ADVANCES - The right to recover any loans or advances made before the appointed day by Bihar or Uttar Pradesh to any local body, society, agriculturist, or other person in the transferred territories shall belong to the State to which the territories are transferred. SECTION 16: REFUND OF TAXES COLLECTED IN EXCESS - The liability of Bihar or Uttar Pradesh to refund any tax or duty on property situate in the transferred territories, including land revenue, collected in excess shall be the liability.....

SECTION 20: CERTAIN ACTS NOT TO APPLY TO MEMBERS OF THE FORCE - Nothing contained inthe Payment of Wages Act, 1936-, orthe Industrial Diusputes Act, 1947-, orthe Factories Act, 1948-, or any corresponding law relating to investigation and settlement of industrial disputes in force in a State shall apply to members of the Force. SECTION 21: PROTECTION OF ACTS OF OFFICERS AND MEMBERS OF THE FORCE - (1) In any suit or proceeding against any51[x x x] member of the Force for any act done by him in the discharge of his duties, it shall be lawful for him to plead that such act was done by him under the orders of a competent authority. (2) Any such plea may be proved by the production of the order directing the act, and if it is so proved, the51[x x x] member of the Force shall thereupon be discharged from any liability in respect of the act so done by him, notwithstanding any defect in the jurisdiction of the authority which issued such order. (3) Notwithstanding anything contained in any other law for the time being in force, any legal proceeding, whether civil or criminal, which may lawfully be brought against any51[x x x] member of the Force for anything done or intended.....
