.....scheme for the development of any river in any region is in operation, the State Government and the generating company shall co-ordinate their activities with the activities of the person responsible for such scheme in so far as they are inter-related. 9. (1) Notwithstanding anything contained in this Act, a person may construct, maintain or operate a captive generating plant and dedicated transmission lines: Provided that the supply of electricity from the captive generating plant through the grid shall be regulated in the same manner as the generating station of a generating company. (2) Every person, who has constructed a captive generating plant and maintains and operates such plant, shall have the right to open access for the purposes of carrying electricity from his captive generating plant to the destination of his use: Provided that such open access shall be subject to availability of adequate transmission facility and such availability of transmission facility shall be determined by the Central Transmission Utility or the State Transmission Utility, as the case may be: Provided further that any dispute regarding the availability of transmission facility.....

THE UNIVERSITY OF PETROLEUM AND ENERGY STUDIES ACT, 2003 THE UNIVERSITY OF PETROLEUM AND ENERGY STUDIES ACT, 2003 [Act No. 15 of 2003] PREAMBLE An Act to establish and incorporate an University in the name of University of Petroleum and Energy Studies with facilities for education, training and research in the areas of Petroleum and Energy Studies and related areas sponsored by Hydrocarbons Education and Research Society, registered under Societies Registration Act, 1860 at New Delhi It is hereby enacted in the Fifty-fourth Year of the Republic of India as follows:-- Section 1 - Short title and commencement (1) This Act may be called the University of Petroleum and Energy Studies Act, 2003. (2) It shall be deemed to have come into force on the date, the notification is issued by the State Government. Section 2 - Definitions (1) In this Act, unless the context otherwise requires:-- (a) "Academic Council" means the Academic Council of the University; (b) "Board of Governors" means the Board of Governors of the University; (c) "Career Academy Centre" means a centre established, maintained or recognized by the University for the purpose of receiving telecast, e-mail,.....

THE UTTARAKHAND POWER DEVELOPMENT FUND (AMENDMENT) ACT, 2009 THE UTTARAKHAND POWER DEVELOPMENT FUND (AMENDMENT) ACT, 2009 [Act No. 13 of 2010] PREAMBLE An Act further to amend the Uttarakhand Power Development Fund Act, 2003 Be it enacted in the Sixtieth Year of the Republic of India by the State Legislature of Uttarakhand as follows:-- Section 1 - Short title, extent and commencement (1) This Act may be called the Uttarakhand Power Development Fund (Amendment) Act, 2009. (2) It shall come into force at once. Section 2 - Amendment of sub-section (3) of Section 7 of the principal Act (1) In place of sub-section (3) of Section 7 of the Uttarakhand Power Development Fund Act, 2003 the following sub-section shall be substituted, namely:-- "(3) For any other schemes/projects directly or indirectly cooperating in the development of Hydro Power Projects, construction of power evacuation system and development of power transmission system in State sector as determined by the Government". .....Warehousing Corporation" means the Central Warehousing Corporation, established or deemed to be established under the Warehousing Corporation Act, 1962 (Act No. 58, 1962); (ix) "Chief Executive Officer" means a person, appointed as such under sub-section (2) of section 36 of the Act, by Agriculture Produce Marketing Committee. (x) "Collector" means the Collector of the District, where the Principal Market Yard of the Market Area is located, and includes such other officer, as may be authorized by him in that behalf; (xi) "Commissioner" means, the Commissioner of such administrative division of the State, where the Principal Market Yard of the Market Area is located;. (xii) "Commission Agent, dalal or arhatiya" means a person, who, in the ordinary course of business, negotiates or arrange contracts for the purchase or sale of the agricultural produce, on behalf of his principal, on payment of his commission or remuneration, whether in cash or kind, but it does not include the servant of such principal, whether engaged in negotiating or arranging such contracts; (xiii) "Committee " means the Agricultural Produce Marketing Committee, constituted under this Act; .....
