Indian Succession Act, 1925 Section 96

Title: Bequest in Alternative

State: Central

Year: 1925

Where a property is bequeathed to a person with a bequest in the alternative to another person or to a class of persons, then, if a contrary intention does not appear by the Will, the legatee first named shall be entitled to the legacy if he is alive at the time when it takes effect; but if he is then dead, the person or class of persons named in the second branch of the alternative shall take the legacy. Illustrations (i) A bequest is made to A or to B. A survives the testator. B takes nothing. (ii) A bequest is made to A or to B. A dies after the date of the Will, and before the testator. The legacy goes to B. (iii) A bequest is made to A or to B. A is dead at the date of the Will. The legacy goes to B. (iv) Property is bequeathed to A or his heirs. A survives the testator. A takes the property absolutely. (v) Properly is bequeathed to A or his nearest of kin. A dies in the lifetime of the testator. Upon the death of the testator, the bequest to A's nearest of kin takes effect. (vi) Properly is bequeathed to A for life, and after this death to B or his heirs. A and B survive the testator. KARNATAKA MUNICIPAL CORPORATIONS ACT, 1976 Section 96

Title: Government's power to direct the taking of action

If, on receipt of any information or report obtained under sections 94 and 95 or otherwise Government is of opinion,- (a) that any duty imposed on any corporation authority by or under this Act has not been performed or has been performed in an imperfect, inefficient or unsuitable manner; or (b) that adequate financial provision has not been made for the performance of any such duty, Government may, after giving notice of not less than fifteen days, by order, direct the corporation or the Commissioner within a period to be specified in the order, to make arrangements to their satisfaction for the proper performance of the duty, or to make financial provision to its satisfaction for the performance of the duty, as the case may be, and the corporation or the Commissioner shall comply with such orders: Provided that no notice shall be necessary in urgent cases.

Title: Regard to Be Had to Social or Religious Usages

When any place used as a human dwelling is entered under this Act, due regard shall be paid to the social and religious customs and usages of the occupants of the place entered, and no apartment in the actual occupancy of a female shall be entered or broken open until she has been informed that she is at liberty to withdraw and every reasonable facility has been afforded to her for withdrawing.

Title: Being Found Under Suspicious Circumstances Between Sunset and Sunrise

Whoever is found between sunset and sunrise,-- (a) armed with any dangerous instrument with intent to commit an offence, or (b) having his face covered, or otherwise disguised with intent to commit an offence, or (c) in any dwelling house or other building, or boat, without being able satisfactorily to account for his presence there, or (d) lying or loitering in any street, yard or other place, being a reputed thief and without being able to give satisfactory account of himself, or (e) having in his possession without lawful excuse (the burden of proving which excuse shall be on such person) any implement of house breaking, shall, on conviction, be punished with imprisonment for a term which may extend to three months.

Karnataka Prohibition Act, 1961 Section 96

Title: Procedure in Confiscation

When an offence under this Act has been committed and the offender is not known or cannot be found or when anything liable to confiscation under this Act is found or seized, the Commissioner, the Deputy Commissioner, or any other Officer authorised by the State Government in this behalf, may make an enquiry and if after enquiry is satisfied that an offence has been committed, may order the thing found to be confiscated: Provided that no such order shall be made before the expiry of one month from the date of seizure or without hearing any person who claims any right thereto and the evidence, if any, which he produces in support of his claim.

Forest Act, 1963 Section 96

Title: Power of Revenue, Forest and Police Officers to Search and Seize Property Liable to Confiscation

Any Revenue Officer not below the rank of a Revenue Inspector or any Forest Officer not below the rank of a Forest Guard or any Police Officer not below the rank of a Head Constable may, within his jurisdiction enter any land and inspect at all reasonable times, stock of cutch, catechu trees felled, boiling of catechu, accounts maintained and for that purpose enter any premises or stop any animal, vehicle, vessel or other conveyance and search the same and seize stocks of catechu trees and cutch together with the packages, coverings and containers thereof in respect of which he has reason to believe that any of the provisions of this Chapter have been contravened, and the driver and other person or persons, who may, for the time being in charge of such animal, vehicle, vessel or other conveyance, shall stop or secure the stopping of such animal, vehicle or other conveyance on demand by the said officer and render all assistance within their power in connection with such search or seizure: Provided that in exercising the power of entry and search due regard shall be paid by such officer to the social and religious customs of the occupants of the premises or vehicle, vessel or ot
