Title: Recovery of Costs from Board

(1) If the Board fails to pay any cost awarded to an appellant within ten days after the date of the order for payment thereof, the District Court awarding the costs may order the person having the custody of the balance of the cantonment fund to pay the amount. (2) Where the appellant fails to pay any costs awarded to the Board within ten days after the date of the order for payment thereof, the same shall be recoverable by the Board in the same manner as moneys recoverable by the Board under section 324.

.....of not less than fifteen days, pass such orders with reference to such matter as it considers necessary; or (ii) direct that the matter pending before the standing committee shall be deemed to be referred to the corporation and be disposed of on that basis: Provided that no such notice shall be necessary in respect of any matter pending before the corporation which is of public importance and the decision of the Government whether the matter is of public importance or not, shall be final. (3) Every order passed by Government under this section shall be communicated to the Commissioner who shall give effect to such order expeditiously as if such order is a resolution of the corporation.

When, during the trial of a case for an offence under this Act, the Court decides that anything is liable to confiscation under section 94, the Court may, after hearing the person, if any, claiming any right thereto and the evidence, if any, which he produces in support of his claim, order confiscation or in the case of any article other than an intoxicant, hemp, mhowra flowers or molasses, give the owner the option to pay fine as the Court deems fit in lieu of confiscation: Provided that no animal, vessel, vehicle or other conveyance shall be confiscated, if the owner thereto satisfies the Court that he had exercised due care in preventing the commission of the offence.

(1) Where the provisions of this Act are put in force for the purpose of acquiring land at the cost of any fund controlled or managed by a local authority or of any Requiring Body, the charges of land incidental to such acquisition shall be defrayed from or by such fund or Requiring Body. (2) In any proceeding held before a Collector or Authority concerned in such cases the local authority or Requiring Body concerned may appear and adduce evidence for the purpose of determining the amount of compensation: Provided that no such local authority or Requiring Body shall be entitled to demand a reference to the Authority concerned under section 64.

Nothing contained in section 94 shall affect,- (a) any right, privilege, obligation or liability acquired, accrued or incurred under the Companies Act; (b) any penalty or punishment incurred in respect of any offence committed under the Companies Act; (c) any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty or punishment as aforesaid; or (d) any winding up proceedings commenced before the coming into force of this Act; and any such investigation, legal proceeding, or remedy may be instituted, continued or enforced and any such penalty or punishment may be imposed and any such winding up proceedings may be continued as if this Act had not been passed : Provided that anything done or any action taken (including any appointment made, notification, order or direction issued, rules or regulations made) under the Companies Act shall, in so far as it is not inconsistent with this Act, be deemed to have been done or taken under the corresponding provisions of this Act and shall continue in force accordingly unless and until superseded by anything done or any action taken under this Act.

Title: Penalty for Obstructing Inspector

Whoever wilfully obstructs an Inspector in the exercise of any power conferred on hi m by or under this Act, or fails to produce on demand by an Inspector any registers or other documents in hi s custody kept in pursuance of this Act or of any rules made thereunder, or conceals or prevents any worker in a factory from appearing before, or being examined by, a n Inspector, shall be punishable with imprisonment for a term which may extend to1[six months] or with fine which may extend to2[ten thousand rupees] or with both. ______________________ 1.
