Indian Evidence Act 1872 Section 82

Title: Presumption as to Document Admissible in England Without Proof of Seal or Signature

Year: 1872

When any document is produced before any Court, purporting to be a document which, by the law in force for the time being in England or Ireland, would be admissible in proof of any particular in any Court of justice in England or Ireland, without proof of the seal or stamp or signature authenticating it, or of the judicial or official character claimed by the person by whom it purports to be signed, the Court shall presume that such seal, stamp or signature is genuine, and mat me person signing it held, at the lime when he signed it, the judicial or official character which he claims, and the document shall be admissible for the same purpose for which it would be admissible in England or Ireland .

Manipur Municipalities Act, 1994 Section 82

Title: Determination of Annual Value of Holding

Year: 1994

"Annual value" means-- (a) in the case of hotels, colleges, schools, hospitals, factories and such other buildings, a proportion not exceeding five per centum, to be fixed by rule made in this behalf of the sum obtained by adding the estimated present cost of erecting the building, less depreciation at the rate to be fixed by rule to the estimated value of the land appurtenant thereto, and (b) in the case of a building or land not falling within the provisions of clause (a), the gross annual rent for which such buildings, exclusive of furniture or machinery therein or such land is actually let, or where the building or land is not let or in the opinion of the municipality is let for a sum less than its fair letting value, might reasonably be expected to let from year to year: Provided that where the annual value of any building would, by reason of exceptional circumstances, in the opinion of the municipality be excessive if calculated in the aforesaid manner, the municipality may fix the annual, value at any less amount which appears to it suitable: Provided further that the rules framed in this behalf shall be subject to the prior approval of the Government.

Assam Rifles Act, 2006 Section 82

Whenever any person subject to this Act who is accused of an offence under this Act, is within the jurisdiction of any magistrate or police officer, such magistrate or police officer shall aid in the apprehension and delivery to Force custody of such person upon receipt of a written application to that effect signed by his Commandant or an officer authorised by the Commandant in that behalf.

Madhya Pradesh Reorganisation Act,2000 Section 82

Where immediately before the appointed day, the existing State of Madhya Pradesh is a party to any legal proceedings with respect to any property, rights or liabilities subject to apportionment between the States of Madhya Pradesh and Chhattisgarh under this Act, the State of Madhya Pradesh or Chhattisgarh which succeeds to, or acquires a share in, that property or those rights or liabilities by virtue of any provision of this Act shall be deemed to be substituted for the existing State of Madhya Pradesh or added as a party to those proceedings, and the proceedings may continue accordingly.

Title: Power of Crown to Disallow Acts of Local Lagislatures

(1) When1[an Act] has been assented to by the Governor- General, he shall send to the Secretary of State an authentic copy thereof, and it shall be lawful for His Majesty2[in Council] to signify3[* *] his disallowance of4[the Act]. (2) Where the disallowance of [an ActJ has been so signified, the governor, lieutenant-governor or chief commissioner shall forthwith notify the disallowance, and thereupon the Act, as from the date of the notification, shall become void accordingly. ________________________ 1. These words were substituted for the words "any such Act" by Part II of Sch. II of the Government of India Act, 1919 (9&10 Geo. 6, Ch. 101). 2. These words were inserted by Part II of the Government of India Act 1919 (9&10 Geo. 5, Ch. 101). 3. The words "through the Secretary of State in Council" were omitted by Part II of the Government of India Act 1919 (9&10 Geo. 5, Ch. 101). 4. These words were substituted for the words "any such Act" by Part II of the Government of India Act 1919 (9&10 Geo. 5, Ch. 101).

Protection of Plant Varieties and Farmers-rights Act, 2001 Section 82

Title: Evidence of Entry in Register, Etc., and Things Done by the Authority and the Registrar

(1) A copy of any entry in the Register, or of any document issued under this Act purporting to be certified by the Authority or the Registrar and sealed with the seal of such Authority or Registrar, as the case may be, shall be admitted in evidence in all courts and in all proceedings without further proof or production of the original. (2) A certificate purporting to be under the hand of the Authority or the Registrar, as the case may be, as to any entry, matter or things that such Authority or Registrar is authorised by this Act or the rules to make or do shall be prima facie evidence of the entry having been made, and of the content thereof, or of the matter or things having been done or not done.

Marine Insurance Act, 1963 Section 82

Where the premium, or a proportionate part thereof, is, by this Act, declared to be returnable-- (a) if already paid, it may be recovered by the assured from the insurer, and, (b) if unpaid, it may be retained by the assured or his agent.
