Title: Disobedience of Orders & Breach of Trust by Officers or Servants or the Company in India, Misdemeanors

* * *1 every wilful disobeying, and every wilful omitting,forbearing, or neglecting to execute the orders or instructions of the said court ofdirectors by any governor general of India, governor, member of council, or commander in chief,or by any other of the officers or servants of the said company, unless in cases ofnecessity (the burthen of the proof of which necessity shall be on theperson so disobeying or omitting, forbearing or neglecting, to execute such orders orinstructions as aforesaid), and every wilful breach of the trust and duty ofany office or employment by any such governor general, governor, member of council, or commander in chief,or any of the officers or servants of the said company, shall be deemedand taken to be a misdemeanor at law, and shall or may be proceeded against andpunished as such by virtue of this Act. ___________________________ 1. Title: Accident in Doing a Lawful Act

Nothing is an offence which is done by accident or misfortune, and without any criminal intention or knowledge in the doing of a lawful act in a lawful manner by lawful means and with proper care and caution. Illustration A is at work with a hatchet; the head flies off and kills a man who is standing by. Here, if there was no want of proper caution on the part of A, his act is excusable and not an offence.

Title: Certified Copy of Entry in Marriage-register, Etc., to Be Evidence

Every certified copy, purporting to be signed by the person entrusted under this Act with the custody of any marriage-register or certificate, or duplicate, required to be kept or delivered under this Act, of any entry of a marriage in such register or of any such certificate or duplicate, shall be received as evidence of the marriage purporting to be so entered, or of the facts purporting to be so certified therein, without further proof of such register or certificate, or duplicate, or of any entry therein, respectively, or of such copy. {Subs.by Act 13 of 1911, section. 2, for the original section. 81.}

Indian Evidence Act 1872 Section 80

Title: Presumption as to Documents Produced as Record of Evidence

Whenever any document is produced before any Court, purporting to be a record or memorandum of the evidence, or of any part of the evidence, given by a witness in a judicial proceedings or before any officer authorised by law to take such evidence or to be a statement or confession by any prisoner or accused person, taken in accordance with law, and purporting to be signed by any judge or Magistrate or by any such officer as aforesaid the Court shall presume-- that the document is genuine; that any statements as to the circumstances under which it was taken, purporting to be made by the person signing it, are true, and that such evidence, statement or confession was duly taken.

Negotiable Instruments Act, 1881 Section 80

Title: Interest when No Rate Specified

When no rate of interest is specified in the instrument, interest on the amount due thereon sh all,1[notwithstanding any agreement relating to interest between any parties to the instrument], be calculated at the rate of2[eighteen per centum] per annum, from the date at which the same ought to have been paid by the party charged, until tender or realization of the amount due thereon, or until such date after the institution of a suit to recover such amount as the Court directs. Explanation.-- When the party charged is the indorser of an instrument dishonoured by non-payment, he is liable to pay interest only from the time that he receives notice of the dishonour. _____________________ 1 . Presidency Small Cause Courts Act, 1882 Section 80

If any clerk, bailiff or other inferior ministerial officer of the Small Cause Court is charged with extortion or misconduct while acting under colour of its process, or with not duly paying or accounting for any money levied by him under its authority, the Court may inquire into such charge, and may make such order for the repayment or payment of any money so extorted, or of any money so levied as aforesaid, and of damages and costs, by such officer, as it thinks fit.

Registration Act, 1908 Section 80

Title: Fees Payable on Presentation

.....Sub-Divisional Magistrate as regards the registration offices within his own jurisdiction may frame and publish lists of persons proved to his satisfaction or to the satisfaction of any Sub-Registrar as provided in section 80C, by evidence of general repute or otherwise, habitually to act as torts, and may from time to time, alter and amend such lists. (2) No person's name shall be included in any such list until he shall have had an opportunity of showing cause against such inclusion. (3) Where the name of any person is included in a list framed and published by a Sub-Divisional Magistrate under this section, such person may, within thirty days of the publication of the list in which his name first appears, apply in writing to the Registrar the district for the removal of his name from such list and the orders of the Registrar, passed after such inquiry (if any) as he considers necessary on such application shall be final. 80C.
