Government of India Act, 1858 [Repealed] Section 75

Title: Provisions as to Proceedings in India Before the Act is Proclaimed there

State: Central

Year: 1858

This Act shall be proclaimed in the several Presidencies and Governments of India as soon, as conveniently may be after such Act has been received by the Governor General of India; and until such Proclamation be made all Acts, Matters, and Things done, ordered directed, or authorised in India in the Name of the East India Company, or otherwise in relation to the Government of India, shall be as valid and effectual as if this Act had not been passed.

Indian Contract Act, 1872 Section 75

Title: Party Rightfully Rescinding Contract Entitled to Compensation

Year: 1872

A person who rightfully rescinds a contract is entitled to compensation for any damage which he has sustained through the non-fulfilment of the contract. Illustration A, a singer, contracts with B, the manager of a theatre, to sing at his theatre for two nights in every week during the next two months, and B engages to pay her 100 rupees for each night's performance. On the sixth night, A wilfully absents herself from the theatre, and B, in consequence, rescinds the contract. B is entitled to claim compensation for the damage which he has sustained through the non-fulfilment of the contract.

Northern India Canal and Drainage Act, I873 Section 75

Title: Power to Make, Alter and Cancel Rules

.....given under any provision of this Act, and not expressly provided for as regards appeal, shall be appealable; (3) the persons by whom, {Ins.by Act 12 of 1891.} [and] the time, place or manner at or in which anything for the doing of which provision is made under this Act, shall be done; (4) the amount of any charge made under this Act; and (5) generally to carry out the provisions of this Act. Government of India Act, 1935 [Repealed] Section 75

Title: Assent to Bills

State: Central

Year: 1935

A Bill which has been passed by the Provincial Legislative Assembly or, in the case of a Province having a Legislative Council, has been passed by both Chambers of the Provincial Legislature, shall be presented to the Governor, and the Governor in his discretion shall declare either that he assents in His Majesty's name to the Bill, or that he withholds assent therefrom, or that he reserves the Bill for the consideration of the Governor-General: Provided that the Governor may in his discretion return the Bill together with a message requesting that the Chamber or Chambers will consider the Bill or any specified provisions thereof and, in particular, will consider the desirability of introducing any such amendments as he may recommend in his message and, when a Bill is so returned, the Chamber or Chambers shall reconsider it accordingly.

Income Tax Act, 1961 Section 75

Title: Losses of Firms

Where the assessee is a firm, any loss in relation to the assessment year commencing on or before the 1st day of April, 1992, which could not be set-off against any other income of the firm and which had been apportioned to a partner of the firm but could not be set-off by such partner prior to the assessment year commencing on the 1st day of April, 1993, then such loss shall be allowed to be set-off against the income of the firm subject to the condition that the partner continues in the said firm and to be carried forward for setoff under sections 70, 71, 72, 73, 74 and 74A.

Title: Jurisdiction of Civil Courts Barred in Respect of Certain Matters

Save as otherwise expressly provided in this Act, no civil court shall entertain any suit or proceedings in so far as it relates to any matter to which this Act applies or to any other matter which the Rent Authority is empowered by or under this Act to decide, and no injunction in respect of any action taken or to be taken by the Rent Authority or the Tribunal under this Act shall be granted by any civil court or other authority.
