Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 Section 54

Title: Cognizance of Offiences

(1) No court shall take cognizance of any offence punishable under this Act except on a complaint-- (a)made by, or with the previous sanction in writing of, the Director-General or the Chief Inspector; or (b) made by an office-bearer of a voluntary organisation registered under the Societies Registration Act, 1860 (21 of 1860); or (c) made by an office-bearer of any concerned trade union registered under the Trade Unions Act, 1926 (16 of 1926). (2) No court inferior to that of a Metropolitan Magistrate or a Judicial Magistrate of the first class shall try any offence punishable under this Act.

(1) No actor proceeding of the Board of Directors of a subsidiary bank shall be questioned on the ground merely of the existence of any vacancy in, or defect in the constitution of, the Board. (2) All acts done by any person acting in good faith as a director of a subsidiary bank shall, notwithstanding that be was disqualified to be a director or that there was any other defect in his appointment, be deemed to be valid.

Title: When Order to Commence Hostilities is Sent to India, the Fact to Be Communicated to Parliament

When any Order is sent to India directing the actual Commencement of Hostilities by Her Majesty's Forces in India, the Fact of such Order having been sent shall be communicated to both Houses of Parliament within Three Months after the sending of such Order, if Parliament be sitting, unless such Order shall have been in the meantime revoked or suspended, and if Parliament be not sitting at the end of such Three Months then within One Month after the next Meeting of Parliament.

(1) Any person aggrieved by the order of the competent authority refusing to grant a certificate or revoking a certificate may, within such period as may be prescribed by the State Government, prefer an appeal to that Government against such refusal or revocation. Title: Examination of Arrested Person by Medical Officer

.....sub-section (1), a copy of the report of such examination shall be furnished by the registered medical practitioner to the arrest person or the person nominated by such arrested person.] STATE AMENDMENT 1[ Uttar Pradesh: In section 54 , the following sentence shall be inserted at the end, namely:- "The registered medical practitioner shall forthwith furnish to the arrested person a copy of the report of such examination free of cost." After Section 54 , the following section shall be inserted, namely:-- " 54 -A. Test identification of the accused.- When a person is arrested on a charge of committing an offence and hi s test identification by any witness is considered necessary by any Court having jurisdiction, it shall be lawful for an Executive Magistrate acting at the instance of such Court, to hold test identification of the person arrested."."

Title: Exhibition and Surrender of Passes and Tickets

Title: Continuance of Arrangements in Regard to Generation and Supply of Electric Power and Supply of Water

If it appears to the Central Government that the arrangement in regard to the generation or supply of electric power or the supply of water for any area or in regard to the execution of any project for such generation or supply has been or is likely to be modified to the disadvantage of that area by reason of the fact that it is, by virtue of the provisions of Part II, outside the State in which the power stations and other installations for the generation and supply of such power, or the catchment area, reservoirs and other works for the supply of water, as the case may be, are located, the Central Government may give such directions as it deems fit, to the State Government or other authority concerned for the maintenance, so far as practicable, of the previous arrangement.
