Provided also * * *1that it shall not be lawful for the said governor general in council without the previous sanction of the said court of directors, to make any law or regulation whereby power shall be given to any courts of justice, other than the courts of justice established by his Majesty's charters, to sentence to the punishment of death any of his Majesty's natural-born subjects born in Europe, or the children of such subjects, or which shall abolish any of the courts of justice established by his Majesty's charters. ____________________________ 1. Title: Stock Standing in the Name of the Company Transferred

Such Government Stock or Stocks as at the Time of the Commencement of this Act may be standing in the Name of the East India Company in the Books of the said Governor and Company shall be transferred by the Chief Cashier or the Chief Account ant of the said Governor and Company to the proper Account or Accounts to be raised as aforesaid.

Christian Marriage Act1872 Section 46

Title: Petition when Marriage Registrar Refuses Certificate

Whenever a Marriage Registrar refuses to issue a certificate under this Part, either of the parties intending marriage may apply by petition, where the district of such Registrar is within any of the towns of Calcutta, Madras and Bombay, to a Judge of the High Court, or if such district is not within any of the said towns, then to the District Judge. Procedure on petition.- The said Judge of the High Court, or District Judge, as the case may be, may examine the allegations of the petition in a summary on way, and shall decide thereon. The decision of such Judge of the High Court or District Judge, as the case may be, shall be final, and the Marriage Registrar to whom the application for the issue of a certificate was originally made shall proceed in accordance therewith.

Title: Facts Bearing Upon Opinions of Experts

Facts, not otherwise relevant, are relevant if they support or are inconsistent with the opinion of experts, when such opinions are relevant. Illustrations (a) The question is, whether A was poisoned by a certain poison. The fact that other persons, who were poisoned by that person, exhibited certain symptoms which experts affirm or deny to be the symptoms of that poison, is relevant. (b) The question is, whether an obstruction to a harbour is caused by a certain sea­wall. The fact that other harbours similarly situated in other respects, but where there were no such sea-walls began to be obstructed at about the same time, is relevant.

Punjab Laws Act, 1872 Section 46

Title: Surveillance, Etc., of Band Failing to Comply with Magistrates Order

If any such band fail to comply with the orders of the said Magistrate within the prescribed period, he shall report the matter to the State Government, and the State Government may give such directions for the surveillance, control or deportation of such band as to it seems fit.

Northern India Canal and Drainage Act, I873 Section 46

Title: Power to Contract for Collection of Canal-dues

The Divisional Canal-officer or the Collector may enter into an agreement with any person for the collection and payment to the State Government by such person of any sum payable under this Act by a third party. When such agreement has been made, such person may recover such sum by suit as though it were a debt due to him, or an arrear of rent due to him on account of the land, work or building in respect of which such sum is payable, or for or in which the canal-water shall have been supplied or used. If such person makes default in the payment of any sum collected by him under this section, such sum may be recovered from him b the Collector under section 45; and, if such sum or any part of it t still due by the said third party, the sum or part so due may be recovered in like manner by the Collector from such third party.
