Title: Manufacture, Sale or Possession by One Person on Account of Another

1[(1) Where any excisable article or hemp has been manufactured or sold or is possessed by any person on account of any other person, and such other person knew or had reason to believe at the time of such manufacture or sale that such manufacture or sale was on his account, or knows or has reason to believe that such possession is on his account, the article shall, for the purposes of this Act be deemed to have been manufactured or sold by, or to be in the possession of, such other person. (2) Nothing in sub-section (1) shall absolve any person who manufactures, sells or has possession of an excisable article or hemp on account of another person from liability to any punishment under this Act, for the unlawful manufacture, sale or possession of such article. ______________ 1. Agricultural Produce (Grading and Marking) Act, 1937 Section 3A

Title: Powers of Entry, Inspection and Search

(1) Any officer of the Central Government or a State Government or any authority, being an officer of a gazette drank or of equivalent rank, authorised by the Central government may, if he has reason to believe that any provision of this Act or the rules made there under has been, or is being, contravened, enter any premises at any reasonable time and make necessary inspection of, and search for, the agricultural produce in relation to which such contravention has been, or is being, made. (2) Every authorisation made under sub-section (1) shall be deemed to be a warrant referred to in Section 93 of the Code of Criminal Procedure, 1973.
