Government of India Act, 1935 [Repealed] Section 313

.....expenses of the Governor-General in discharging his func- tions as respects matters with respect to which he is required by the pro- visions of this Act for the time being in force to act in his discretion shall be defrayed out of the revenues of the Governor-General in Council. (4) Any requirement in this Act that the Governor-General shall ex-ercise his individual judgment with respect to any matter shall not come into force, until the establishment of the Federation, but, notwithstanding that Part II of this Act has not come into operation, the following provi-sions of this Act, that is to say-- (a) the provisions requiring the prior sanction of the Governor- General for certain legislative proposals; (b) the provisions relating to broadcasting; (c) the provisions relating to directions to, and principles to be observed by, the Federal Railway Authority; and (d) the provisions relating to civil services to be recruited by the Secretary of State, shall have effect in relation to defence, ecclesiastical affairs, external affairs and the tribal areas as they have effect in relation to matters or functions with respect to, or in the exercise of which the.....

Karnataka Municipalities Act, 1964 Section 313

Title: Power of Government to Provide for Performance of Duties in Default of Municipal Council

State: Karnataka

Year: 1964

(1) When the Government is informed, on complaint made or otherwise, that a municipal council has made default in performing any duty imposed on it by or under this Act, or by or under any law for the time being in force, the Government, if satisfied after due inquiry that the municipal council has been guilty of the alleged default, may fix a period for the performance of that duty. (2) If that duty is not performed within the period so fixed, the Government may appoint some person to perform it, and may direct that the expenses of performing it, with a reasonable remuneration to the person appointed to perform it, shall be forthwith paid by the municipal council. (3) If the expense and remuneration are not so paid, the Government may make an order directing any person, who for the time being has custody of any moneys on behalf of the municipal council, to pay such expense and remuneration from such moneys as he may have in his hands or may from time to time receive, and such person shall be bound to obey such order.
