Title: Power to Summon Material Witness, or Examine Person Present

Year: 1973

Any Court may, at any stage of any inquiry, trial or other proceeding under this Code, summon any person as a witness, or examine any person in attendance, though not summoned as a witness, or recall and re-examine any person already examined; and the Court shall summon and examine or recall and re-examine any such person if his evidence appears to it to be essential to the just decision of the case.

Indian Succession Act, 1925 Section 311

Title: Powers of Several Executors or Administrators Exercisable by One

When there are several executors or administrators, the powers of all may, in the absence of any direction to the contrary, be exercised by any one of them who has proved the Will or taken out administration. Illustrations (i) One of several executors has power to release a debt due to the deceased. (ii) One has power to surrender a lease. (iii) One has power to sell the property of the deceased whether movable or immovable. (iv) One has power to assent to a legacy. (v) One has power to endorse a promissory note payable to the deceased. (vi) The Will appoints A, B, C and D to be executors, and directs that two of them shall be a quorum. No act can be done by a single executor.

Karnataka Municipalities Act, 1964 Section 311

Title: Power of Commissioner to Prevent Extravagance in the Employment of Establishment

(1) If in the opinion of the Commissioner the number of persons who are employed by a municipal council as officers or servants or whom a municipal council proposes to employ or the remuneration assigned by the municipal council to those persons, or to any particular person is excessive, the municipal council shall, on the requirement of the Commissioner, reduce the number of the said persons or the remuneration of the said person or persons: Provided that the municipal council may appeal against any such requirement to the Government whose decision thereon shall be conclusive.

Title: Increase in Remuneration of Managing Director Onre-appointment or Appointment After Act to Require Government Sanction

In the case of a public company, or a private company which is a subsidiary of a public company, if the terms of any re-appointment or appointment of a managing or whole-time director, made after the commencement of this Act, purport to increase or have the effect of increasing, whether directly or indirectly, the remuneration which the managing or whole-time director or the previous managing or whole-time director, as the case may be, was receiving immediately before such re-appointment or appointment, the re-appointment or appointment and shall become void if, and insofar as it is disapproved by that Government1[shall not have any effect-- (a) in cases where Schedule XIII is applicable, unless such increase is in accordance with the conditions specified in that Schedule; and (b) in any other case, unless it is approved by the Central Government.] _______________________ 1. Cantonments Act, 2006 Section 311

Title: Owner`s Consent Ordinary to Be Obtained

Save as otherwise expressly provided in this Act, no building or land shall be entered without the consent of the occupier, or if there is no occupier of the owner thereof, and no such entry shall be made without giving the said occupier or owner, as the case may be, not less then four hours, written notice of the intention to make such entry: Provided that no such notice shall be necessary if the place to be inspected is a factory or workshop or trade premises or a place used for carrying on any trade, calling or occupation specified in section 277 or a stable for horses or a shed for cattle or a latrine privy or urinal or a work under construction, or fur the purpose of ascertaining whether any animal intended for human food is slaughtered in that place in contravention of this Act or any bye-law made thereunder.

Karnataka Panchayat Raj Act, 1993 Section 311

Title: Power of Government to Make Rules

State: Karnataka

(1) The Government may after previous publication, by notification in the Official Gazette make rules to carry out the purposes of this Act. (2) A rule under this Act may be made with retrospective effect and when such a rule is made the reasons for making the rule shall be specified in a statement laid before both Houses of the State Legislature. Subject to any modification made under section 320 every rule made under this Act shall have effect as if enacted in this Act. (3) In making a rule under this section, the Government may provide that a person guilty of breach thereof shall, on conviction, be punished with fine which may extend to five hundred rupees and where the breach is a continuing one with further fine which may extend to twenty-five rupees for every day on and after the first day on which the breach continues.
