Title: Repeal and Saving

(1) The Prevention of Terrorism (Amendment) Ordinance, 2003(Ord. 4 of 2003), is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the Prevention of Terrorism Act, 2002(15 of 2002), as amended by the said Ordinance, shall be deemed to have been done or taken under the said Act, as amended by this Act.

For the purposes of this Act, (a) "departmental inquiry" means an inquiry held under and in accordance with-- (i) any law made by Parliament or any rule made there under, or (ii) any rule made under the proviso to article 309, or continued under article 313 of the Constitution of India, into any allegation of lack of integrity against any person to whom this Act applies; (b) "inquiring authority" means an officer or authority appointed by the Central Government or by any officer or authority subordinate to that Government to hold a departmental inquiry and includes any officer or authority who is empowered by or under any law or rule for the time being in force lo hold such inquiry; (c) "lack of integrity" includes bribery or corruption.

Where, in pursuance of the Convention or Agreement with any other country or countries, it is necessary to grant exemption from levy of taxes and duties, on fuel and lubricants filled into receptacles forming part of any aircraft of any other country or countries under any law of a State or Union territory in India, the Central Government may, by notification in the Official Gazette, make such provisions as may be necessary for giving effect to the said Convention or Agreement and thereupon the said provision shall apply accordingly and, notwithstanding anything contrary contained in any other law, shall in such application have the force of law in India.

Title: Power to Grant Extraordinary Pensions and Gratuities

Notwithstanding anything contained in any enactment or in any rule made thereunder regulating the powers of local authorities, and without prejudice to any powers conferred by or under any such enactment, a local authority may grant a pension or gratuity to any officer thereof who may, since the 4th day of August, 1914, have been wounded or otherwise incapacitated in [The words "the service of Government" successively amended by the A.O.1937 and the A.O.1950.] [service under the Government], and to the widow or child of any such officer who may have died in consequence of injuries received or illness contracted since the 4th day of August, 1914, in the course of such service.

Title: Effect of Certain Orders

Any order made- (i) by the highest Court of appeal in relation to Chandemagore before the 2nd day of May1950, or in any proceeding pending before that Court on that day; or (ii) by the Chief Commissioner of the Andaman and Nicobar Islands before the commencement of this Act in the discharge of his functions as the High Court for those Islands, shall for all purposes have effect, not only as an order of that Court, or as the case may be, of the Chief Commissioner, but also as if it were an order made by the High Court at Calcutta.

Title: Carriers Not to Be Liable for Loss of Certain Goods Above One Hundred Rupees in Value, Unless Delivered as Such

No common carrier shall be liable for the loss of or damage to property delivered to him to be carried exceeding in value one hundred rupees and of the description contained in the Schedule to this Act, unless the person delivering such property to be carried, or some person duly authorised in that behalf, shall have expressly declared to such carrier or his agent the value and description thereof.
