Title: Preventing Service of Summons or Other Proceeding, or Preventing Publication Thereof

Indian Succession Act, 1925 Section 173

Title: Annuity Created by Will Payable for Life Only Unless Contrary Intention Appears Will

State: Central

Year: 1925

Where an annuity is created by Will, the legatee is entitled to receive it for his life only, unless a contrary intention appears by the Will, notwithstanding that the annuity is directed to be paid out of the property generally, or that a sum of money is bequeathed to be invested in the purchase of it. Illustrations (i) A bequeaths to B 500 rupees a year. B is entitled during his life to receive the annual sum of 500 rupees. (ii) A bequeaths to B the sum of 500 rupees monthly. B is entitled during his life to receive the sum of 500 rupees every month. (iii) A bequeaths an annuity of 500 rupees to B for life, and on B's death to C. B is entitled to an annuity of 500 rupees during his life. C, if he survives B, is entitled to an annuity of 500 rupees from B's death until his own death.

Title: Provisions as to Other Property

.....property vested in His Majesty and under the control of the Secretary of State in Council immediately before the commencement of Part III of this Act shall as from the com-mencement of Part III of this Act vest in His Majesty for the purposes of the Government of the Federation, for the purposes of the exercise of the iunctions of the Crown in its relations with Indian States or for the purpose of the Government of a Province, according as the Secretary of State may determine having regard to the circumstances of the case, and the Secretary of State shall have power to and shall deal with the property accordingly. (3) In this section "property" includes money, securities, bank balanceand moveable property of any description. (4) Arrears of any taxes outstanding immediately before the com-mencement of Part III of this Act shall be deemed to be due to and may berecovered by the Federal Government or a Provincial Government accord-ing as the proceeds of any such tax imposed after the commencement ofPart III of this Act would be due to and recoverable by the Federal gov-ernment or the Provincial Government. Title: Communication of Certain Orders to Prison Officers

Whenever an order is duly made under this Act setting aside or varying any sentence, order or warrant under which any person is confined in a civil or military prison, a warrant in accordance with such order shall be forwarded by the officer making the order or his staff officer or such other person as may be prescribed to the officer in charge of the prison in which such person is confined.
