156. Amendment of1[Karnataka]2[Act 16 of 1958] In schedule II to the1[Karnataka] Court Fees and Suits Valuation Act, 1958, the following amendments shall be, and shall be deemed to have been, made with effect from the 1st October 1964, namely:- (a) in clause (ii) of Article 3, after the words "1[Karnataka Revenue Appellate Tribunal] ", the words "or the Co-operative Appellate Tribunal" shall be inserted. (b) in clause (j) of Article 10 after the words "1[Karnataka Revenue Appellate Tribunal] ", the words " or the Co-operative Appellate Tribunal" shall be inserted. ______________________ 1. Title: Term of Office of Members of State Legislative Councils

(1) The term of office of a member of the Legislative Council of a State, other than a member chosen to fill a casual vacancy, shall be six years, but upon the first constitution of the Council the Governor1[***] shall, after consultation with the Election Commission, make by order such provision as he thinks fit for curtailing the term of office of some of the members then chosen in order that, as nearly as may be, one-third of the members holding seals of each class shall retire in every second year thereafter. (2) A member chosen to fill a casual vacancy shall be chosen to serve for the remainder of his predecessor's term of office. ______________________ 1. Title: Travelling on Roof, Step or Engine of a Train

If any passenger or any other person, after being warned by a railway servant to desist, persists in travelling on the roof, step or footboard of any carriage or on an engine, or in any other part of a train not intended for the use of passengers, he shall be punishable with imprisonment for a term which may extend to three months, or with fine which may extend to five hundred rupees, or with both and may be removed from the railway by any railway servant.

Title: Dealing with Property of Deceased Seamen

(1) An Indian consular officer or a shipping master to whom the effects of a deceased seaman or apprentice are delivered or who takes charge of such effects under this Act may, if he thinks fit, sell the effects, and the proceeds of any such sale shall be deemed to form part, of the property of the deceased seaman or apprentice. (2) Before selling any valuables comprised in the said effects, such officer of shipping master shall endeavour to ascertain the wishes of the next-of-kin of the deceased seaman or apprentice as to the disposal of such valuables and shall, if practicable and lawful, comply with such wishes. (3) An Indian consular officer to whom any property of a deceased seaman or apprentice is delivered or who takes charge of any such property under this Act shall remit the property to the shipping master at the port of engagement of the deceased seaman or apprentice in such manner and shall render such accounts in respect thereof as may be prescribed.

Title: Effect of Mixture Without Bailors Consent, when the Goods Can Be Separated

If the bailee, without the consent of the bailor, mixes the goods of the bailor with his own goods, and the goods can be separated or divided, the property in the goods remains in the parties respectively; but the bailee is bound to bear the expense of separation or division, and any damage arising from the mixture. Illustrations A bails 100 bales of cotton marked with a particular mark to B. B, without A's consent, mixes the 100 bales with other bales of his own, bearing a different mark; A is entitled to have his 100 bales returned, and B is bound to bear all the expense incurred in the separation of the bales, and any other incidental damage.

Title: Adjustment in Respect of Certain Expenses and Pensions

Where under the provisions of this Act the expenses of any court or commission, or the pension payable to or in respect of a person who has served under the Crown in India, are charged on the revenues of the Federation or the revenues of a Province, then if (a) in the case of a charge on the revenues of the Federation the court or commission serves any of the separate needs of a Province, or the person has served wholly or in part in connection with the affairs of a Province; or (b) in the case of charge on the revenues of a Province, the court for commission serves any of the separate needs of the Federation or another Province, or the person has served wholly or in part in connection with the affairs of the Federation or another Province, there shall be charged on and paid out of the: revenues of the Province or, as the case may be, the revenues of the Federation or of the other Province, such contribution in respect of the expenses or pension as may agreed, or as may in default of agreement be determined by an arbitrator to be appointed by the Chief Justice of India.

Title: Effect of Certificate of Insurance

When an insurer has issued a certificate of insurance in respect of a contract of insurance between the insurer and the insured person, then (a) if and so long as the policy described in the certificate has not been issued by the insurer to the insured, the insurer shall, as between himself and any other person except the insured, be deemed to have issued to the insured person a policy of insurance conforming in all respects with the description and particulars stated in such certificate; and (b) if the insurer has issued to the insured the policy described in the certificate, but the actual terms of the policy are less favourable to persons claiming under or by virtue of the policy against the insurer either directly or through the insured than the particulars of the policy as stated in the certificate, the policy shall, as between the insurer and any other person except the insured, be deemed to be in terms conforming in all respects with the particulars stated in the said certificate.
