Cantonments Act, 2006 Section 152

Title: Power to Require Closing of Burial or Burning Ground

.....of, persons living in the neighbourhood, it may with the previous sanction of the Central Government by notice in writing, require the owner or person in charge of such ground to close the same from such date as may be specified in the notice. (2) Where the Central Government sanctions the issue of any notice under subsection (1) it shall declare the conditions on which the burial or burning ground may be reopened, and a copy of such declaration shall be annexed to the notice. (3) Where the Central Government sanctions the issues of any such notice, it shall require a new burial or burning ground to be provided at the expense of the cantonment fund, or, if the community concerned is willing to provide a new burial or burning ground, the Central Government shall require a grant to be made from the cantonment fund towards the cost of the same. (4) No corpse shall be buried or burnt in any burial or burning ground in respect of which a notice issued under this section is for the time being in force.

Title: List of Members of the State Legislative Assemblies and Electoral Colleges to Be Maintained by Returning Officers Concerned

Motor Vehicles Act, 1988 Section 152

Title: Settlement Between Insurers and Insured Persons

(1) No settlement made by an insurer in respect of any claim which might be made by a third party in respect of any liability of the nature referred to in clause (b) of sub-section (1) of section 147 shall be valid unless such third party is a party to the settlement. (2) Where a person who is insured under a policy issued for the purposes of this Chapter has become insolvent, or where, if such insured person is a company, a winding-up order has been made or a resolution for a voluntary winding-up has been passed with respect to the company, no agreement made between the insurer and the insured person after the liability has been incurred to a third party and after the commencement of the insolvency or winding-up, as the case may be, nor any waiver, assignment or other disposition made by or payment made to the insured person after the commencement aforesaid shall be effective to defeat the rights transferred to the third party under this Chapter, but those rights shall be the same as if no such agreement, waiver, assignment or disposition or payment has been made.

Karnataka Police Act, 1963 Section 152

Title: Reserve Police Officer to Be Deemed to Be in Charge of Police Station

(1) When employed on active duty at any place under sub-section (1) of section 151, the senior reserve police officer of the highest rank not being lower than that of a Naik present shall be deemed to be an officer in charge of the police station for the purposes of Chapter IX of the Code of Criminal Procedure, 1898. (2) Notwithstanding anything contained in sections 100 and 103 of the Indian Penal Code, a Reserve Police Officer employed as aforesaid may, when there is reasonable apprehension of assault on himself or any Reserve Police Officer or of damage or harm to any property or person which or whom it is his duty to protect, use such force to the wrong doer or assailant as may be reasonably necessary even though the use of such force may involve risk of death of the wrong doer or the assailant or any other person assisting such wrong doer or assailant.

.....with the transition to the provisions of this Act or giving effect to the provisions of this Act; (c) so far as it appears necessary or expedient in connection with any of the matters aforesaid for varying the powers or jurisdiction of any court or authority and empowering new courts or other authorities to exercise such jurisdiction as may be specified in such order. (2) The provisions made by any order under sub-section (1) shall, subject to the provisions of section 149, have effect as if enacted in this Act, and any such order may be made so as to be retrospective to any date not earlier than the date of commencement of this Act: Provided that no person shall be deemed to be guilty of an offence by reason of so much of any such order as makes any provision thereof retrospective to any date before the making thereof.

Title: Effect of Suspension and Remission on Dismissal

(1) Where in addition to any other sentence the punishment on dismissal has been awarded by a Force Court, and such other sentence is suspended under section 144, then, such dismissal shall not take effect until so ordered by the authority or officer specified in section 144. (2) If such other sentence is remitted under section 148, the punishment on dismissal shall also be remitted.
