.....by the Bombay Entertainments Duty (Extension and Amendment) Act, 1958 (Bom. XLI of 1958), the Central Provinces and Berar Entertainments Duty Act, 1936 (M.P. Act of XXX of 1936), the Entertainments Tax Act, 1355F (Hyd. V of 1955F), the Saurashtra Entertainment Duty Ordinance, 1949 (Sau. Ord. VIII of 1949), and any other law relating to entertainment tax shall, from such commencement in that part, stand repealed: Provided that, such repeal shall not affect- (a) the previous operation of the enactments and laws so repealed, or (b) any penalty or punishment incurred in respect of any offence committed against any of the provisions of the enactments and laws so repealed, or (c) any investigation, legal proceeding or remedy, in respect of such penalty or punishment; and any such investigation, legal proceeding or remedy may be instituted, continued or enforced and any such penalty or punishment may be imposed as if the Bombay Entertainments Duty (Extension and Amendment) Act, 1958 (Bom. Any infant milk substitute or feeding bottle or infant food or container thereof, in respect of which any provision of this Act has been or is being contravened, shall be liable to confiscation: Provided that where it is established to the satisfaction of the court adjudging the confiscation that the person in whose possession, power or control any such substitute or bottle or food or container is found is not responsible for the contravention of the provisions of this Act, the court may, instead of making an order for the confiscation of such substitute or bottle or food or container, make such other order authorised by this Act against the person guilty of the breach of the provisions of this Act as it may think fit.

Title: Notification for General Election to the House of the People

(1) A general election shall be held for the purpose of constituting a new House of the People on the expiration of the duration of the existing House or on its dissolution. (2) For the said purpose the President shall, by one or more notifications published in the Gazette of India on such date or dates as may be recommended by the Election Commission call upon all Parliamentary constituencies to elect members in accordance with the provisions of this Act and of the rules and orders made thereunder: Provided that where a general election is held otherwise than on the dissolution of the existing House of the People, no such notification shall be issued at any time earlier than six months prior to the date on which the duration of that House would expire under the provisions of clause (2) of article 83.

If it shall appear necessary before the close of the case for the prosecution, the commissioners may in their discretion allow the prosecutor to exhibit evidence not included in the list given to the person accused, or may themselves call for new evidence; and in such case the person accused shall be entitled to have, if he demands it, an adjournment of the proceedings for three clear days, before the exhibition of such new evidence exclusive of the day of adjournment and of the day to which the proceedings are adjourned.

Title: Power to Alter Position of Gas or Water Pipes or Drains

The telegraphauthority may, for the purpose of exercising the powers conferred upon it bythis Act in respect of any property vested in or under the control ormanagement of a local authority, alter the position thereunder of any pipe (notbeing a main) for the supply of gas or water, or of any drain (not being a maindrain): Providedthat-- (a)When the telegraph authroity desires to alter the position of any such pipe ordrain, it shall give reasonable notice of its intention to do so, specifyingthe time at which it will begin to do so, to the local authority, and, when thepipe or drain is not under the control of the local authority, to the personunder whose control the pipe or drain is; (b)a local authority or person receiving notice under clause (a) may send a personto superintend the work, and the telegraph authority shall execute the work tothe reasonable satisfaction of the person so sent.

Title: Absence of Chairman and Deputy Chairman

If the Chairman or the Deputy Chairman is, by infirmity or otherwise, rendered incapable of carrying out his duties or is absent on leave or otherwise, in circumstances not involving the vacation of his appointment, or is sent on deputation outside India for any of the purposes of this Act, the Central Government may appoint another person to act in his place during his absence: Provided that the Chairman or the Deputy Chairman, while on deputation outside India, may, if the Central Government by order so directs and subjets to such conditions and restrictions as may be specified in that order, exercise such of the powers and perform such of the duties conferred or imposed on the Chairman or the Deputy Chairman, as the case may be, by or under this Act as he may deem necessary, and the Chairman or Deputy Chairman while exercising such powers and performing such duties shall be deemed to be a Trustee notwithstanding anything to the contrary contained in this Act.
