Air Force Act, 1950 Section 107

Title: Inquiry into Absence Without Leave

State: Central

Year: 1950

(1) When any person subject to this Act, has been absent from his duty without due authority for a period of thirty days, a Court of inquiry shall, as soon as practicable, be assembled, and such Court shall, on oath or, affirmation administered. In the prescribed manner, inquire respecting the absence of the person, and the deficiency , if any, in the property of the Government entrusted to his care, or in any arms, ammunition, equipment, instruments, clothing or nedessaries, and if satisfied of the fact of such absence without due authority, or other sufficient cause, the Court shall declare such absence and the period thereof, and the said deficiency, if any; and the commanding officer of the unit to which the person belongs shall enter in the court-martial book of the unit a record of declaration. (2) If the person declared absent does not afterwards surrender or is not apprehended, he shall, for the purposes of this Act, be deemed to be a deserter.

(1) Any enrolment paper purporting to be signed by an enrolling officer shall, in proceedings under this Act, be evidence of the person enrolled having given the answers to questions which he is therein represented as having given. (2) The enrolment of such person may be proved by the production of the original or a copy of his enrolment paper purporting to be certified to be a true copy by the officer having the custody of the enrolment paper or service record.

Title: Abetment of a Thing

.....of that thing, if an act or illegal omission lakes place in pursuance of that conspiracy, and in order to the doing of that thing; or Thirdly.--Intentionally aids, by any act or illegal omission, the doing of that thing. Explanation 1.A person who by wilful misrepresentation, or by wilful concealment of a material fact which he is bound to disclose, voluntarily causes or procures, or attempts to cause or procure, a thing to be done, is said to instigate the doing of that thing. Illustration A, a public officer, is authorized by a warrant from a Court of Justice to apprehend Z. B, knowing that fact and also that C is not Z, wilfully represents to A that C is Z, and thereby intentionally causes A to apprehend C. Here B abets by instigation the apprehension of C. Explanation 2.--Whoever, either prior to or at the time of the commission of an act, does anything in order to facilitate the commission of that act, and thereby facilitate the commission thereof, is said to aid the doing of that act.

Title: Powers of High Court with Respect to Subordinate Courts

Each ofthe high courts has superintendence over all courts for the time being subject to its appellatejurisdiction, and may do any of the following things, that is to say:-- (a) call for returns; (b) direct the transfer of any suit or appeal from any such court any other court of equal or superiorjurisdiction; (c) make and issue general rules and prescribe forms for regulating thepractice and proceedings of such courts; (d) prescribe forms in which books, entries and accounts shall be kept by the officers of anysuch courts; and (e) settle tables of fees tobeallowed to the sheriff, attorneys and all clerks and officers of courts: Providedthat such rules, forms and tables shallnot be inconsistent with the provisions of any 1 [law] for the timebeing in force, and shallrequire the previous approval, in the case of the high court at Calcutta, ofthe Governor-General in Council, and inother cases of the local government. _________________________ 1. Title: Continuance of Arrangements in Regard to Generation and Supply of Electric Power and Supply of Water
