Coal Mines Taking over of Management Act 1973 Section 10

Title: Mining Companies Not to Be Wound Up by Court

State: Central

Year: 1973

(1) No proceeding for the winding up of a mining company, the management of whose coal mines has vested in the Central Government under this Act, or for the appointment of a Receiver or for any other order in respect of the business of such company, shall lie in any Court except with the consent of the Central Government. (2) Notwithstanding anything contained in the Companies Act, 1956, or in any memorandum or articles of association of any mining company or in any instrument, no resolution passed at any meeting of the Board of Directors or of the members of a mining company shall, in so far as relates to the coal mine owned by such company or any business of such mine, be given effect to unless approved by the Central Government. (3) Subject to the other provisions contained in this Act and subject to such exceptions, restrictions and limitations, if any, as the Central Government may, by notification in the Official Gazette specify in this behalf, the Companies Act, 1956, shall continue to apply to every mining company in the same manner as they applied to it before the appointed day.

(3) The Custodian shall maintain an account of the undertakings of the Company in such form and manner and under such conditions as may be prescribed and the provisions of the Companies Act, 1956( 1 of 1956 ), shall apply to the audit of the account so maintained as they apply to the audit of the accounts of a company.

The major Part of the Persons to be elected by the Court of Directors, and the major Part of the Persons to to be first appointed by Her Majesty after the passing of this Act to be Members of the Council, shall be Persons who shall have served or resided in India for Ten Years at the least, and (excepting in the Case of late and present Directors and Officers on the Home Establishment of the East India Company who shall have so served or resided) shall not have last left India more than Ten Years next preceding the Date of their Appointment ; and no Person other than a Person so qualified shall be appointed or elected to fill any Vacancy in the Council unless at the Time of the Appointment or Election Nine at the least of the continuing Members of the Council be Persons qualified as aforesaid.

Emigration Act, 1983 Section 10

Title: No Person to Function as Recruiting Agent Without a Valid Certificate

Save as otherwise provided in this Act, no recruiting agent shall, after the commencement of this Act, commence or carry on the business of recruitment except under and in accordance with a certificate issued in that behalf by the registering authority: Provided that a person carrying on the business of recruiting agent immediately before the commencement of this Act may continue to carry on such business without such a certificate for a period of one month from such commencement and if he has made an application for such certificate under this Act within the said period of one month and such application is in the prescribed form and contains the prescribed particulars, till the disposal of such application by the registering authority.

Title: Governing Body and Other Committees of Institute
