Consideration of report of examiner by Controller.-Where, in respect of an application for a patent, the report of the examiner received by the Controller is adverse to the applicant or requires any amendment of the application or of the specification to ensure compliance with the provisions of this Act or of the rules made thereunder, the Controller, before proceeding to dispose of the application in accordance with the provisions hereinafter appearing, shall communicate the gist of the objections to the applicant and shall, if so required by the applicant within the prescribed time, give him an opportunity of being heard.

Any person who shall, in making {Subs.by Act 55 of 1955, s.12, for "any declaration" (w.e.f.1st July 1956)} [any declaration or other statement] under the authority of this Act, make a statement which is false, and which he either knows or believes to be false or does not believe to be true, shall on conviction before a Magistrate, be punished by fine out exceeding { Subs.by Act 14 of 1922, s.3 and Sch.I, for "five thousand"} [two thousand] rupees, and imprisonment for a term not exceeding { Subs.by s.3 and Sch.I, ibid., for "two years"} [six months].
