.....THE BOMBAY RENTS, HOTEL AND LODGING HOUSE RATES CONTROL ACT, 1947 THE BOMBAY RENTS, HOTEL AND LODGING HOUSE RATES CONTROL ACT, 1947 [REPEALED ACT] [Act, No. 57 of 1947] (For Statement of Objects and Reasons, See Bombay Government Gazette, 1947, Part V, page 364.) [13th January 1948] PREAMBLE An Act to amend and consolidate the law relating to the control of rents andrepairs of certain premises, of rates of hotels and lodging houses and of evictions. WHEREAS it is expedient to amend and consolidate the law relating to the control of rents and repairs of certain premises, of rates of hotels and lodging house and of evictions ; It is hereby enacted as follows:- Section 1 - Short title This Act may be called the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947. Section 2 - Extent (1) Parts I and IV of this Act shall extend to the1[Bombay area of the State of Maharashtra]. (2)2[Parts II and IIA shall extend to the areas specified in Schedule I and Part III shall extend to the areas specified in Schedule II] to this Act and shall continue to extend to any such area notwithstanding that the area ceases to be of the description therein specified. .....

.....IN CERTAIN CASES No notice shall be issued under section 7-if the house- (a) was, at the date of the issue of the notification declaring this Act or the Cantonments(House-Accommodation) Act, 1902, as the case may be, to be operative in the cantonment or part of the cantonment, or is, with such sanction as is required bisection 9-, occupied as a hospital, school, school hostel, bank, hotel or shop, and has been so occupied continuously during the three years immediately preceding the time when the occasion for issuing the notice arises, or (b) was, at the date of such a notification as is referred to in clause (a), or is, with such sanction as aforesaid, occupied by a railway administration or by a company or firm engaged in trade or business or by a club. or (c) is occupied by the owner, or (d) has been appropriated by the33 [State Government] with the concurrence of the Officer Commanding the District, or by the34'[Central Government], for use as a public office or for any other purpose. The Act of 1995 has been enacted with a view to regulate the promotion of the construction, transfer and management of apartments on ownership basis, to regulate colonies and property transactions and to provide for registration of promoters and estate agents and enforcement of obligations on promoters and estate agents and for matters connected therewith or incidental thereto. Before the enactment of 1995 Act, the Punjab Regulation of Colonies Act, 1975 occupied the field. However, it was felt that the private colonizers were operating in the State with the sole motive of making profits without regard to the interest and rights of individual buyers of plots/flats. In order to check, control and regulate the activities of private colonisers and protect the interest of the consumers keeping in view the National Housing Policy, the Legislature enacted the 1995 Act. Title: Conditions on Which Houses May Be Appropriated
