Sarais Act, 1867 Section 11

Title: Sale of Materials of Ruinous Sars

State: Central

Year: 1867

If any such sarai or any part thereof be taken down by virtue of the powers aforesaid, the Magistrate of the District may sell the materials thereof, or so much of the same as shall be taken down under the provisions of the last preceding section, and apply the proceeds of such sale in payment of the expenses incurred, and shall restore the overplus (if any) arising from such sale to the owner of such sar on demand, and may recover the deficiency (if any) as if the amount thereof were a penalty under this Act.

Sarais Act, 1867 Complete Act

.....apply to any Sarai which may be under the direct management of the7[State Government] or of any Municipal Committee. SECTION 17: EXTENT OF ACT This Act shall in the first instance extend only to the territories under the Government of the Lieutenant-Governor of the North-Western Provinces of the Presidency of Fort William in Bengal. Power to State Government to extend this Act. But it shall be lawful for the 9[State Government], by notification in the10[official Gazette] to extend this Act, mutatis mutandis, to any other part of11[the territories under its Government], except; the towns of Calcutta, Madras and bombay12[* * *]. SECTION 18: SHORT TITLE This Act may be called The Sarais Act. 1867. SCHEDULE 1 FORM OF NOTICE Take notice that on the day of 1867, an Act called the Sarais Act, 1867, was passed, and that, before the day of 18 , you, being keeper of a Sarai [or purao] within there state the district over which the jurisdiction of the Magistrate giving the notice extends], must have your sarai [or purao] registered, and that the register is to be kept at [here state where the register is to be kept) and that, if you do not have your sarai [or purao] so.....

Title: Of Printing-presses and Newspapers

.....for "of the declaration" by the Press and Registration of Books (Amendment) Act, 1960, w.e.f. 29-08-1960. Section 5A - Jammu and Kashmir Act No.1 of S.1989 1[ 5A .Jammu and Kashmir Act No.1 of S.1989.- (1) No person who has made and subscribed a declaration in respect of any press under section 4 of the Jammu and Kashmir State Press and Publications Act, S.1989 shall keep the press in his possession for the printing of books or papers2[after the 31stday of December, 1968, unless before the expiry of the date]he makes and subscribes a fresh declaration in respect of that press under section 4 of this Act. (Keepers of printing presses and printers and publishers of newspapers in Jammu and Kashmir to make and subscribe fresh declarations within specified period. (2) Every person who has subscribed to any declaration in respect of a newspaper under section 5 of the Jammu and Kashmir State Press and Publications Act, S.1989 shall cease to be the editor, printer or publisher of the newspaper mentioned in such declaration2[after the 31stday of December, 1968, unless before the expiry of the date]he makes and subscribes a fresh declaration in respect of that newspaper.....

.....of the provisions of this Act or rules made thereunder; or (ii) the newspaper, mentioned in the declaration bears a title which is the same s, or similar to, that of any other newspaper published either in the same language or in the same State; or (iii) the printer or publisher has ceased to be the printer or publisher of the newspaper mentioned in such declaration.or (iv) the declaration was made on false representation or on the concealment of any material fact or in respect of periodical work which is not a newspaper; the Magistrate may, by order, cancel the declaration and shall forward s soon as possible a copy of the order to the person making or subscribing the declaration and also to the Press Registrar. ______________________ 1. BE it enacted by Parliament in the Sixth Year of the Republic of India as follows :- 1 .Short title and commencement.- (1) This Act may be called the Press and Registration of Books (Amendment) Act, 1955. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. 2 .Amendment of long title.- In the long title of the Press and Registration of Books Act, 1867 (XXV of 1867) (hereinafter referred to as the principal Act), after the word "books" occurring in both the places, the words "and newspapers' shall be inserted. 3 .Amendment of preamble.- In the preamble to the principal Act, for the words "every book printed or lithographed in India and for the registration of such books", the words "every book and newspaper printed in India and for the registration of such books and newspapers" shall be substituted. 4 .Amendment of.....

.....satisfied that- (i) the newspaper, in respect of which the declaration has been made is being published in contravention of the provisions of this Act or rules made thereunder; or (ii) the newspaper, mentioned in the declaration bears a title which is the same s, or similar to, that of any other newspaper published either in the same language or in the same State; or (iii) the printer or publisher has ceased to be the printer or publisher of the newspaper mentioned in such declaration.or (iv) the declaration was made on false representation or on the concealment of any material fact or in respect of periodical work which is not a newspaper; the Magistrate may, by order, cancel the declaration and shall forward s soon as possible a copy of the order to the person making or subscribing the declaration and also to the Press Registrar. 8C.Appeal.-(1) Any person aggrieved by an order of a Magistrate refusing to authenticate a declaration under section 6 or cancelling a declaration under section 8B may, within sixty days from the date on which such order is communicated to him, prefer an appeal to the Appellate Board to be called the Press and Registration Appellate Board.....

Sarais Act, 1867 Section 9

Title: Power to Shut Up Secure Clear and Clean Deserted Sars

Year: 1867

If any sarai by reason of abandonment or of disputed ownership shall remain untenanted, and thereby become a resort of idle and disorderly persons, or become in a filthy or unwholesome state, or be complained of by any two or more of the neighbours as a nuisance, the Magistrate of the District, after due enquiry, may cause notice in writing to be Vienna to the owner or to the person claiming to be the owner, if he be known and resident within the district, and may also cause such notice to be put on some conspicuous part of the sarai, requiring the persons concerned therein, whoever they may be, to secure, enclose, clean or clear the same; and if such requisition shall not be complied with eight days, the Magistrate of the District may cause the necessary work to be executed, and all expenses thereby incurred shall be paid by the owner of the sarai and shall be recoverable like penalties under this Act, or, in case of abandonment or disputed ownership of the sarai, by the sale of any material found therein.
