THE SIKKIM PRISONS ACT, 2007 THE SIKKIM PRISONS ACT, 2007 (Act No. 16 of 2007) AN ACT To provide for a law regulating the prisons in Sikkim. Be it enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows: - CHAPTER I Short title, extent and commencement. 1. (1) This Act may be called the Sikkim Prisons Act, 2007 (2) It extends to the whole of Sikkim; (3) It shall come into force on such date as the State Government may, by notification, in the official gazette appoint. Definitions. In this Act, unless the context otherwise requires: - (a) "civil prisoner" means any prisoner who is not a criminal prisoner; 2 . (b) "Competent authority" means any officer having jurisdiction and legal authority to deal with a particular matter in question; (c) "convicted criminal prisoner" means any criminal prisoner under sentence of court or court-martial, and includes a person detained in prison under the provision of Code of Criminal Procedure, 1973; (d) "Court" includes any officer lawfully exercising civil, criminal or revenue jurisdiction; (e) "criminal prisoner" means any prisoner duly committed to custody.....

Title: Amendment of Section 11 of Act 25 of 1956

In the All-India Institute of Medical Sciences Act, 1956, in section 11, after sub-section (1), the following sub-section shall be inserted, namely:-- "(1A) The Director shall hold office for a term of five years from the date on which he enters upon his office or until he attains the age of sixty-five years, whichever is earlier: Provided that any person holding office as a Director immediately before the commencement of the All-India Institute of Medical Sciences and the Post-Graduate Institute of Medical Education and Research (Amendment) Act, 2007, shall in so far as his appointment is inconsistent with the provisions of this sub-section, cease to hold office on such commencement as such Director and shall be entitled to claim compensation not exceeding three months' pay and allowances for the premature termination of his office or of any contract of service.".

.....extended by a maximum period of one year in individual cases by the Appointing authority if he considers it necessary to do so. (2) (a) After satisfactory completion of the trial period employees will be continued in the temporary posts. (b) Employees recruited against permanent vacancies will be confirmed therein after satisfactory completion of probation, provided that the employees have passed the prescribed Hindi Examination. (3) (a) Except as otherwise provided in this sub-regulation, every employee of the Commission (other than an honorary worker or a Government Servant) shall retire on the day he attains the age of sixty years. (b) Notwithstanding anything contained in clause (a), the Commission shall, if it is of the opinion that it is in public interest to do so, have the absolute rights to retire any employee by giving him notice of not less than three months in writing or three months pay and allowances in lieu of such notice; (i) if he is Group A of Group - B service or post and had entered the services of the Commission before attaining the age of thirty five years after he has attained the age of fifty years; (ii) in all other cases after he has attained the age.....

THE ARMED FORCES TRIBUNAL ACT, 2007 THE ARMED FORCES TRIBUNAL ACT 2007 AN ACT to provide for the adjudication or trial by Armed Forces Tribunal of disputes and complaints with respect to commission, appointments, enrolment and conditions of service in respect of persons subject to the Army Act, 1950, the Navy Act, 1957 and the Air Force Act 1950 and also to provide for appeals arising out of orders, findings or sentences of court martial held under the said Acts and for matters connected therewith or incidental thereto. BE it enacted by Parliament in the Fifty-eighth Year of the Republic of India as follows :- CHAPTER 1 PRELIMINARY 1. Short title and commencement : (1) This Act may be called the Armed Forces Tribunal Act, 2007. (2) It shall come into force on such date as the Central Government may, by notification, appoint. 2. Applicability of the Act : (1) The provisions of this Act shall apply to all persons subject to the army Act, 1950, (46 of 1950) the Navy Act, 1957 (62 of 1957) and the Air Force Act, 1950 (45 of 1950) (2) This Act shall also apply to retired personnel subject to the Army Act, 1950 (46 of 1950) or the Navy Act, 1957 (62 of 1957) or the Air.....
