THECONSTITUTION (DISTRIBUTION OF REVENUES) ORDER, 1951 C.O. 28, dated the 31st March, 1951 Inexercise of the powers conferred by articles 270, 273 and 275 of theConstitution of India and of all other powers enabling him in that behalf, thePresident is pleased to make the following Order, namely :-- 1.(1) This Order may be called the Constitution (Distribution of Revenues) Order,1951.1 (2) It shall come into force on the firstday of April, 1951. 2.The provisions of paragraphs 3 and 4 of the Constitution (Distribution ofRevenues) Order, 1950, 2 shall apply in relationto the year ending on the 31st day of March, 1952, as they apply in relation tothe year ending on the 31st day of March, 1951, subject to the modificationthat in the table appended to paragraph 4 of the said Order entries relating to"Punjab" shall be omitted. ________________________ 1.Thisorder was repealed by C. .....Article 341 of theConstitution of India, as amended by the Constitution (First Amendment) Act,1951, the President is pleased to make the following Order, namely :-- 1.This Order may be called the Constitution (Scheduled Castes) (Part C States)Order, 1951. 2.Subject to the provisions of this Order, the castes, races or tribes or partsof, or groups within, castes or tribes, specified in 1 [Parts I to IX]of the Schedule to this Order-shall, in relation to the States to which thoseParts respectively relate, be deemed to be Scheduled Castes so far as regardsmembers thereof resident in the localities specified in relation to themrespectively in those Parts of that Schedule. 3.Notwithstanding anything contained in Paragraph 2, no person who professes areligion different from Hinduism shall be deemed to be a member of a ScheduledCaste : Providedthat every member of the Kabirpanthi, Mazhabi, Ram Dasia, Ravidasi or Raidasi orSikligar caste resident in the State of Delhi and Kabirpanthi or Julaha or Keer,Mazhabi, Ramdasi or Ravi-dasi, Ramdasia or sikligar caste resident in the Stateof Himachal Pradesh shall, in relation to that State, be deemed to be a. memberof the Scheduled.....

O. 40 Dated the 19th April, 1952 THE CONSTITUTION (DISTRIBUTION OF REVENUES) ORDER, 1952 In exercise of the powers conferred by articles 270, 273 and 275 of the Constitution of India and. of all other powers enabling him in that behalf, the President, after considering the provisional recommendations of the Finance Commission, is pleased to make the following Order, namely :-- 1. This Order may be called the Constitution (Distribution of Revenues) Order, 1952.1 2. The provisions of paragraphs 3 and 4 of the Constitution (Distribution of Revenues) Order, 19502, shall apply in relation to the financial year commencing on the 1st day of April, 1952, as they apply in relation to the financial year commencing on the 1st day of April, 1950, subject to the modification that, in the table appended to paragraph 4 of the said Order, the entries relating to P'unjab shall be omitted. ____________________ 1 . Title: Adaptation of Laws (Fourth Amendment) Order, 1952

.....of India or of the export of the goods out of such territory, or (b) except in so far as Parliament may bylaw otherwise provide, after the 31st day of March, 1951, in the course of inter-State trade or commerce, and the provisions of this Act shall be read and construed accordingly. Explanation.-- For the purposes of clause (a) (i), a sale or purchase shall be deemed to have taken place in the State in which the goods have actually been delivered as'a direct result of such sale or purchase for the purpose of consumption in that State, notwithstanding the fact that under the general law relating to sale of goods, the property in the goods has by reason of such sale or purchase passed in another State." _______________________ 1. .....powers enabling him in that behalf, thePresident, after having considered the recommendations of the FinanceCommission, hereby makes the following Order :-- 1.This Order may be called the Constitution (Distribution ofRevenues) Order, 1953. 2.The General Clauses Act, 1897 (X of 1897) applies for the interpretation ofthis Order as it applies for the interpretation of a Central Act. 3.(1) For the purposes of clause (2) of article 270, two and three-quarters percent, of so much of the net proceeds of taxes on income as does not representthe net proceeds of taxes payable in respect of Union emoluments shall representthe proceeds attributable to C States for each financial year commencing on andafter the first day of April, 1952. (2)The percentage of the net proceeds of the taxes on income, except in so far asthose proceeds represent proceeds, attributable to Part C States or to taxespayable in respect of Union emoluments, which is to be assigned to Part A Statesand Part B States (other/than the State of Jammu and Kashmir) under the saidclause in each of the financial years commencing on and after the first day ofApril, 1952; shall be 55 per cent.
