THE AYUSH AND HEALTH SCIENCES UNIVERSITY OF CHHATTISGARH ACT, 2008 THE AYUSH AND HEALTH SCIENCES UNIVERSITY OF CHHATTISGARH ACT, 2008 [Act No. 21 of 2008] ( Published in Chhattisgarh Rajpatra (Asadharan) dated 16-9-2008 Pages 616(44-85).) [16th September, 2008] PREAMBLE An Act to establish and incorporate a teaching, research and affiliating university for the purpose of ensuring efficient and systematic education, training, research and development of Health Sciences including Modern System of Medicine, Ayurved, Yoga and Naturopathy, Unani, Siddha, Homoeopathy, Dentistry, Pharmacy, Physiotherapy, Nursing, Public Health. Be it enacted by the Chhattisgarh Legislature in the Fifty-ninth Year of the Republic of India as follows:-- Section 1 - Short title, extent and commencement (1) This Act may be called the Ayush and Health Sciences University of Chhattisgarh Act, 2008. (2) It extends to the whole of the State of Chhattisgarh. (3) It shall come into force on such date as the State Government may appoint by Notification in the Official Gazette. SECTION 24 : Recognition of medical qualifications granted by Institute Notwithstanding anything contained in the Indian Medical Council Act, 1956 the Dentist Act, 1948, the Indian Nursing Council Act, 1947, the medical degrees and diplomas, dental degrees and nursing degrees granted by the Institute under this Act shall be recognised medical qualifications for the purposes of the Acts aforesaid and shall be deemed to be included in the Schedules to the respective Acts. SECTION 25 : Control by Central Government The Institute shall carry out such directions as may be issued to it from time to time by the Central Government for the efficient administration of this Act. SECTION 26 : Resolution of differences If in, or in connection with, the exercise of its powers and discharge of its functions by the Institute under this Act, any dispute arises between the Institute and the Central Government, the decision of the Central Government thereon shall be final. SECTION 27 : Returns and information The Institute shall furnish to the Central Government such reports, returns and other information as that Government may require from time to time. For section 24 of the principal Act, the following section shall be substituted, namely:-- "24. Recognition of medical dental and nursing qualifications granted by the Institue - Notwithstanding anything contained in the Indian Medical Council Act, 1956, the Dentists Act, 1948 and the Indian Nursing Council Act, 1947, the medical dental or nursing degrees or diplomas, as the case may be, granted by the Institute under this Act shall be recognised-- (a) medical qualifications for the purpose of the Indian Medical Council Act, 1956 and shall be deemed to be included in the First Schedule to that Act; (b) dental qualifications for the purpose of the Dentists Act, 1948 and shall be deemed to be included in the Schedule to that Act; and (c) nursing qualifications for the purpose of the Indian Nursing Council Act, 1947 and shall be deemed to be included in the Schedule to that Act.".

(2) If the person has not paid the compensation under sub-section (1), the said sum shall be recovered under the provisions of the Tamil Nadu Revenue Recovery Act, 1864 (Tamil Nadu Act 2 of 1884) as if it were an arrear of land revenue. 6. Bar of certain proceedings.- No claim for compensation for the damage or loss caused to the property shall be made by the medicare service person or medicare service institution, before any authority, under the Tamil Nadu Property (Prevention of Damage and Loss) Act, 1992 (Tamil Nadu Act 59 of 1992). 7. Operation of other laws not affected.- Save as otherwise provided in this Act, the provisions of this Act shall be in addition to and not in derogation of, any other law for the time being in force. 8. Repeal and saving.- (1) The Tamil Nadu Medicare Service Persons and Medicare Service Institutions (Prevention of Violence and Damage or Loss to Property) Ordinance, 2008 (Tamil Nadu Ordinance 3 of 2008) is hereby repealed.
