.....it was inexpedient that the appointment of the Kazi-ul-Kuzaat, or of City, Town or Pargana Kazis should be made by the Government, and by the same Act the enactments relating to the appointment by Government of the said officers were repealed; and whereas by the usage of the Muhammadan community in some parts of1[India] the presence of Kazis appointed by the Government is required at the celebration of marriages and the performance of certain other rites and ceremonies, and it is therefore expedient that the Government should again be empowered to appoint persons to the office of Kazi; It is hereby enacted as follows :-Maharashtra: In its application to the State of Maharashtra in the long title and in the preamble after the words "office of kazi" insert the words "and to cast certain duties on persons discharging the functions of a Kazi". See Mah. Act 21 of 1978, Sections 2,3 (9-10-1978). SECTION 01: SHORT TITLE This Act may be called The Kazis Act, 1880; 3[* * * *]. Local extent.- It extends, in the first instance, only to the territories administered by the Governor of Fort St. George in Council.4[But the Government of any other State] may, from time to time, by notification.....

SECTION 07: UPON A DISSOLUTION NO MEMBER TO RECEIVE PROFIT - If upon the dissolution of any such body there remains, after the satisfaction of all its debts and liabilities, any property whatsoever, the same shall not be paid to or distributed among the members of such body or any of them, but shall be given to some other body of persons associated for the purpose of maintaining religious worship or some other religious or charitable purpose to be determined by the votes of not less than three-fifths of the members present at a meeting convened in this behalf, or in default thereof by such court as last aforesaid. SECTION 08: SAVING OF CERTAIN PROVISIONS OF INSTRUMENTS - Nothing in sections 6-and7-shall be deemed to affect any provisions contained in any instrument for the dissolution of such body, or for the payment or distribution of such property. SECTION 09: QUESTIONS MAY BE SUBMITTED TO HIGH COURT - When any question arises, either in connection with the matters hereinbefore, referred to, or otherwise, as to whether any person is a member of any such body as aforesaid, or as to the validity of any appointment under this Act, any person interested in.....

Title: Appointment Under Section 2 to Be Recorded in a Memorandum Under the Hand of the Chairman of the Meeting

Every appointment of new trustees under section 2 shall be made to appear by some memorandum under the hand of the chairman for the time being of the meeting at which such appointment is made. Such memorandum shall be in the form set forth in the schedule hereto annexed, or as near thereto as circumstances allow, shall be executed and attested by two or more credible witnesses in the presence of such meeting, and shall be deemed to be a document of which the registration is required by the Indian Registration Act, 1877[See now the Indian Registration Act, 1908 (16 of 1908)] section 17.

.....27 Grantees to be responsible for all damages The grantees shall be answerable for all accidents, damages and injuries happening through their act or default, or through the act or default of any person in their employment by reason or in consequence of any of their works or carriages, and shall save harmless the Corporation and their officers and servants from all damages and costs in respect of such accidents, damages and injuries. Section 28 Power for the Corporation and police to regulate traffic on roads Nothing in this Act shall limit the powers of the Corporation or the police to regulate the passage of any traffic along or across any road along or across which any tramways are laid down, and the Corporation or police may exercise their authority as well on as off the tramway, and with respect as well to the traffic of the grantees as to the traffic of other persons.
