INDIAN COUNCILS ACT, 1909 [Act, No. 4 of 1909] [25th May, 1909] PREAMBLE An Act to amend the Indian Councils Acts, 1861 and Indian Councils Acts, 1892 , and the Government of India Act, 1833 . BE it enacted by the King's most Excellent Majesty by, and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows: --

SECTION 06: LAVING OF PROCLAMATIONS, ETC., BEFORE PARLIAMENT All proclamations, regulations, and rules made under this Act, other than rules made by a Lieutenant- Governor for the more convenient transaction of business in his council, shall be laid before both Houses' of Parliament as soon as may be after they are made. SECTION 07: SHORT TITLE, CONSTRUCTION, COMMENCEMENT AND REPEAL (1) This Act may be cited as the Indian Councils Act, 1909, and shall be construed with the Indian Councils Acts, 1861andIndian Councils Acts, 1892 and those Acts, the Indian Councils Act, 1869 the Indian Councils Act, 1871 the Indian Councils Act, 1874, the Indian Councils Act, 1904 and this Act may be cited together as the Indian Councils Acts, 1861toIndian Councils Acts, 1909. (2) 3 This Act shall come into operation on such date or dates as the Governor-General in Council, with the approval of the Secretary of State in Council, may appoint, and different dates may be appointed for different purposes and provisions of this Act and for different Councils. ....."If this Bill be passed into law it will be necessary to repeal the 1848 Act, and this raise a question which deserves consideration. The present Act is an Act of the imperial Parliament and a vesting order made under it vests in the assignee by direct operation all the real and personal estate and effects of the insolvent in whatever part of the King's dominions they may be situate or accrue; and a discharge under the Act has effect in every part of those dominions. The Act is one of those which it is within the competency of the Legislative Council of the Governor-General to repeal, but if it be repealed and an Indian Act be substituted, it follows that these advantages must at least for the most part be abandoned, since an Act of the Indian Legislature cannot operate for this purpose outside the limits of India. In 1886 it was proposed that an Act of the Imperial Parliament should be obtained to give this authority to insolvency proceedings in India, but no such Act has as yet been passed. It is believed, however, that the advantages conferred by the Act of 1848 are of no real value, since experience has shown that in practically every case in which there are assets in both.....
