.....pay the sum so due and the company has for three weeks thereafter neglected to pay the sum, or to secure or compound for it to the reasonable satisfaction of the creditor; (b) if execution or other process issued on a decree or order of2[any court or Tr i bunal] in favour of a creditor of the company is returned unsatisfied in whole or in part; or (c) if it is proved to the satisfaction of the3[Tribunal] that the company is unable to pay its debts, and, in determining whether a company is unable to pay its debts, the3[Tribunal] shall take into account the contingent and prospective liabilities of the company. (2) The demand referred to in clause (a) of sub-section (1) shall be deemed to have been duly given under the hand of the creditor if it is signed by any agent or legal adviser duly authorised on his behalf, or in the case of a firm, if it is signed by any such agent or legal adviser or by any member of the firm. _____________________ 1. .....of company Subject to the provisions of this Act as to preferential payments, the assets of a company shall, on its winding up be applied in satisfaction of its liabilities pari passu and subject to such application, shall, unless the articles otherwise provide, be distributed among the members according to their rights and interests in the company. Karnataka Famine Relief Fund Act, 1963 Section 6

Title: Accounts of the Fund and Making Up of the Deficiency in the Fund

(1) The accounts of the Fund shall be made up at the end of each financial year, the securities belonging to the Fund being valued at the market value on the last day of such year. (2) If the accounts so made up show that the balance of the Fund at the end of such year falls short of sixty lakhs of rupees, the deficiency shall be made up from the Consolidated Fund of the State: Provided that if the deficiency exceeds twenty lakhs of rupees, it may be made up in annual instalments, the amount of such instalments except the last being not less than ten lakhs of rupees. (3) Any expenditure incurred by the State Government under sub-section (2) shall be charged on the Consolidated Fund of the State.

Title: Limit of Punishment of Offence Made Up of Several Offences

If A were liable to punishment for every blow, he might be imprisoned for fifty years, one for each blow. But he is liable only to one punishment for the whole beating. (b) But if, while A is beating Z, Y interferes, and A intentionally strikes Y, here, as the blow given to Y is no part of the act whereby A voluntarily causes hurt to Z, A is liable to one punishment for voluntarily causing hurt to Z, and to another for the blow given to Y. _____________________ 1.
