THE PRESIDENCY MAGISTRATES (COURT-FEES) ACT, 1877 [Act, No. 4 of 1877] [AS ON 1956] {Short title given by the Indian Short Titles Act, 1897 (14 of 1897).} [28th February, 1877] PREAMBLE An Act to regulate the procedure and increase the jurisdiction of the Courts of Magistrates in the Presidency-towns. WHEREAS it is expedient to consolidate and amend the law regulating the procedure of the Courts of Magistrates in the Presidency-towns and to increase the jurisdiction of such Courts; It is hereby enacted as follows:--

.....1867, as amended by this Act. And accordingly, notwithstanding anything in any judgment, decree or order of any Court, any such appointment, disciplinary action or order shall be deemed to have been validly made or taken; and any such appointment, disciplinary action or order or anything done by the Police-patels in the exercise of their powers by or under the Bombay Village Police Act, 1867 or any other law for the time being in force shall not be called in question (or if questioned shall not be maintained) in any Court or before any Tribunal or authority merely on the ground that the Magistrate had no power to make the appointment or to take an action, or that the State Government or the Commissioner had no power to interfere in the matter, or had not exercised its or his powers for such interference by or under some other provision of that Act or that the Police-patel was not properly appointed, nor on any ground consequential to the grounds aforesaid. SECTION 04: REPEAL OF MAH. ORD. II OF 1967 The Bombay Village Police (Appointments and Disciplinary Action by Sub-Divisional Magistrates, Validation) Ordinance, 1967, is hereby repealed. .....as follows :- SECTION 01: SHORT TITLE This Act may be called the Maharashtra Construction of References to "District Magistrate" in the Hyderabad Area (Repeal) Act, 1960. SECTION 02: REPEAL OF CERTAIN PROVISIONS RELATING 10 COLLECTORS AND ADDITIONAL DISTRICT MAGISTRATES IN HYDERABAD AREA (1) Any provision of a law which, in effect, provides that references to the District Magistrate in relation to the Hyderabad area or any district therein mean, or shall be construed as references to, "the Collector" or "Collector and Additional District Magistrate" shall be deemed to have ceased to have effect from the first day of September 1959, except as respects things done or omitted to be done before that date. (2) The enactments in the Schedule shall be deemed to have been deleted on the aforesaid date. SCHEDULE 1 SCHEDULE (See section 2) 1. Clause (4-A) of section 3 of the Prisons Act, 1894 (IX of 1894), in its application to the State of Maharashtra. 2. Clause (5-A) of section 2 of the Bombay Police Act, 1951 (Bom. XXII of 1951). 3. PRESIDENCY MAGISTRATES (COURT COURT-FEES) ACT, 1877 PRESIDENCY MAGISTRATES (COURT COURT-FEES) ACT, 1877 4 of 1877 28th February, 1877 An Act to regulate the procedure and increase the jurisdiction of the Courts of Magistrate in the Presidency-towns. Preamble.- WHEREAS it is expedient to consolidate and amend the law regulating the procedure of the Courts of Magistrates in the Presidency-towns and to increase the jurisdiction of such Courts: It is hereby enacted as follows :- SECTION 01:-53 [ Repealed by the Code of Criminal Procedure, 1882 (Act 10 of 1882)- ] SECTION 57: FEES FOR SUMMONSES AND WARRANTS A fee of eight annas shall be paid for every summons or warrant issued by a Presidency Magistrate, except in the case of a summons to attend and give evidence or to produce documents, in which case there shall be paid a fee of four annas: Power to remit fees. Provided that such Magistrate may in any case remit any such fee, if he is satisfied that the complainant is unable to pay the same, and shall remit it when the complaint is made by a public servant in the execution of his duty.
