The Orissa Homeopathic (Amendment) Act, 1994 Complete Act

.....and shall be constituted in the following manner:- (a) a President to be nominated by the State Government; (b) two renowned Homeopathic Practitioners practising in the State of Orissa whose names validly continue for the time being in the register, to be nominated by the State Government; (c) two members to be elected by the Orissa Legislative Assembly from amongst its members in the prescribed manner; (d) the Director, Indian System of Medicines & Homeopathy, Orissa; and (e) one Lady Social Worker having special interest and knowledge in Indian System of Medicines & Homeopathy: Provided that whenever vacancies arise in the Offices specified in clause (c) due to dissolution of the Orissa Legislative Assembly, the State Government may fill up the said vacancies by nominating two persons who shall, unless sooner removed, hold office till the date on which the names of the members elected under the said clause by the Assembly after its reconstitution are published in the Gazette and the term of office of the members so elected shall be co-terminus with the term of office of the members nominated under clause (b)." Act 68 of 1982 The Drugs and Cosmetics Act, 1940, regulates the import into, manufacture, distribution and sale of drugs and cosmetics in the country. The problems of adulteration of drugs and also of production of spurious and sub-standard drugs are posing serious threat to the health of the community. It is, therefore, considered necessary to amend the Drugs and Cosmetics Act, so as to impose more stringent penalties on the anti-social elements indulging in the manufacture or sale of adulterated or spurious drugs or drugs not of standard quality which are likely to cause death or grievous hurt to the user. This opportunity is also being availed of to incorporate certain other provisions on the other aspects of effective control on the manufacture, distribution, sale of drugs and cosmetics on the basis of experience gained in the working of the Act. 2. Section 6 - Overriding effect The provisions of this Act shall have effect notwithstanding anything contained in the Punjab Medical Registration Act, 1916, the Punjab Nurses Registration Act, 1932, the Punjab ayurvedic and Unani Practitioners Act, 1963, and the Punjab Homoeopathic Practitioners Act, 1965, or any rule, regulation or bye-law framed under any of these Acts. Section 7 - Repeal and Saving (1) The Punjab Medical Council, Punjab Nurses Registration Council, Board of Ayurvedic and Unani Systems of Medicine, Punjab and Council of Homoeopathic System of Medicine, Punjab (Miscellaneous Provisions) Ordinance, 1976 (Punjab Ordinance No. 1 of 1977) is hereby repealed. Karnataka Private Nursing Homes (Regulation) Act, 1976 Section 2

In this Act, unless the context otherwise requires,-- (1) 'appointed day' means the date specified in sub--section (2) of section 1; (2) 'competent authority' means any person or persons or authority appointed by the State Government to perform the functions of the competent authority under this Act and different persons or authorities may be appointed to perform different functions; (3) 'licence' means a licence granted under the provisions of this Act ; (4) 'manager' in relation to a private nursing home means the person, by whatever name or designation called, who is in charge of, or is entrusted with, the running of a private nursing home ; (5) 'medical treatment' means treatment in modern medicine or in any other system of medicine like the Ayurvedic, the Unani, the Homeopathic and the Naturopathic ; (6) 'modern medicine' means the western methods of allopathic medicine, obstetrics and surgery ; (7) 'nursing home' means a hospital or a clinic or any other place where human diseases are given preventive and/or curative medical treatment ; (8) 'private nursing home' means a nursing home which is not owned or sponsored by the State or the Central Government ; .....
