[13th January 1948] PREAMBLE An Act to amend and consolidate the law relating to the control of rents andrepairs of certain premises, of rates of hotels and lodging houses and of evictions. WHEREAS it is expedient to amend and consolidate the law relating to the control of rents and repairs of certain premises, of rates of hotels and lodging house and of evictions ; It is hereby enacted as follows:- Section 1 - Short title This Act may be called the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947. Section 2 - Extent (1) Parts I and IV of this Act shall extend to the1[Bombay area of the State of Maharashtra]. (2)2[Parts II and IIA shall extend to the areas specified in Schedule I and Part III shall extend to the areas specified in Schedule II] to this Act and shall continue to extend to any such area notwithstanding that the area ceases to be of the description therein specified. .....

Fair wages payable to motor transport workers .- Notwithstanding anything contained in any other law, rule, order or notification having the force of law or contract, every employer shall pay to any motor transport worker under his employment fair wages in respect of his employment, or the work done in such employment: Provided that the arrears of fair wages payable by an employer for any period prior to the date of publication of this Act in the Gazette shall be paid before the expiry of six months after the date of such publication in not mere than six monthly instalments. 2 ["Provided further that the arrears of fair wages payable by an employer by virtue of the Kerala Motor Transport Workers' Payment of Fair Wages (Amendment) Act, 1988 for any period prior to the date of publication of the said Act shall be paid before the expiry of three months after the date of such publication, in not more than three monthly instalments."] 4. Penalty for non-payment of fair wages.- Any employer who refuses to pay fair wages as provided in this Act to any motor transport worker without reasonable cause shall, on conviction be punishable.....

Title: Levy of Rent by the Ramlila Fair Committee

Notwithstanding anything contained in the Municipal Act or any other law for the time being in force in the Bhilsa Ramlila Area, the Bhilsa Ramlila Fair Committee may, during the period of the fair which shall be notified by the Government in the Gazette levy such rent for the land comprised in the said area as may be specified in the bye-laws to be framed by the said Committee with the approval of the Government.

Title: Appointment of Ramlila Fair Committee

(1) The Government may, by notification in the Gazette, appoint a Committee to be called the Bhilsa Ramlila Fair Committee consisting of-- (i) the Collector of the Bhilsa District who shall be its Chairman; (ii) two persons nominated by the Government; and 1[(ii-a) two Councillors nominated by Municipal Council, Vidisha;] (iii) six persons nominated, from time to time, by Shri Ramlila Sabha (Registered) Bhilsa : provided the Secretary of the said Sabha shall always be one of the persons so nominated. 2[(2) The persons nominated under clauses (ii), (ii-a) and (iii) of sub-section (1), shall hold office for a period of three years : Provided that a member of the Ramlila Committee nominated under clause (ii-a) of sub-section (1) shall cease to hold office as such member if he ceases to be a Councillor of the Municipal Council, Vidisha.] ____________________ 1. Title: Management and Control of Bhilsa Ramlila Fair

As soon as the Bhilsa Ramlila Committee is appointed by the Government under Section 2, the management and control of the Bhilsa Ramlila Fair and the assets and liabilities of the Ramlila Committee, if any, functioning at the time of its appointment together with all funds, if any, shall pass on and be vested in the Committee so appointed.
