THE TRIPURA EYES (AUTHORITY FOR USE FOR THERAPEUTIC PURPOSES) ACT, 1988 THE TRIPURA EYES (AUTHORITY FOR USE FOR THERAPEUTIC PURPOSES) ACT, 1988 An Act To provide for the use of eyes of deceased-persons for therapeutic purposes and for matters connected therewith. Be it enacted by the Tripura Legislative Assembly in the Thirthsixth Year of the Republic of India as follows :- Short title, extent and commencement. 1. (1) This Act may be called the Tripura Eyes (Authority For Use For Therapeutic Purposes) Act, 1988. (2) It extends to the whole of the State of Tripura. (3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint,. Definitions. 2. In this Act, unless the context otherwise requires,- (a) "near relative" in relation to a deceased persons, means any person related to him as spouse, parent, son, daughter, brother or sister and includes any other person who is related to him- (i) by lineal consanguinity within three degrees or by collateral consanguinity within six degrees; or (ii) by marriage with any of the relatives aforesaid. THE KERALA CORNEAL GRAFTING (AMENDMENT) ACT, 1988 [1] THE KERALA CORNEAL GRAFTING (AMENDMENT) ACT, 1988 [1] (ACT 21 OF 1988) An Act to amend the Kerala Corneal Grafting Act, 1963 Preamble. " whereas it is expedient to amend the Kerala Corneal Grafting Act, 1963, for the purpose hereinafter appearing; be it enacted in the Thirty-ninth Year of the Republic of India as follows: " 1. Short title and commencement." (1) This Act may be called the Kerala Corneal Grafting (Amendment) Act, 1988. (2) It shall come into force at once. 2. Amendment of section 3. "In the Kerala Corneal Grafting Act, 1963 (17 of 1963), in section 3, after sub-section (6), the following sub-section shall be inserted, namely: " "(6A) Where the body of a person has been sent for post-mortem examination" (a ) for medico-legal purposes by reason of the death of such person having been caused by accident or any other unnatural cause; or (b ) for pathological purposes, the person competent under this Act to give authority for the removal of the eyes from such dead body may, if he has reason to believe that the eyes will not be required for the purpose for which such body has been sent for post-mortem.....

(6) "conductor's licence" means the licence issued by a competent authority under Chapter III authorising the person specified therein to act as a conductor; (7) "contract carriage" means a motor vehicle which carries a passenger or passengers for hire or reward and is engaged under a contract, whether expressed or implied, for the use of such vehicle as a whole for the carriage of passengers mentioned therein and entered into by a person with a holder of a permit in relation to such vehicle or any person authorised by him in this behalf on a fixed or an agreed rate or sum- (a) on a time basis, whether or not with reference to any route or distance; or (b) from one point to another, and in either case, without stopping to pick up or set down passengers not included in the contract anywhere during the journey, and includes- (i) a maxicab; and (ii) a motorcab notwithstanding the separate fares are charged for its passengers; (8) "dealer" includes a person who is engaged- (a) 1 [ x x x] (b) in building bodies for attachment to chassis; or (c) in the repair of motor vehicles; or (d) in the business of hypothecation, leasing or hire-purchase of motor vehicle; (9).....

Title: Liability Without Fault in Certain Cases

Section 143 - Applicability of Chapter to certain claims under Act 8 of 1923 The provisions of this Chapter shall also apply in relation to any claim for compensation in respect of death or permanent disablement of any person under the Workmen's Compensation Act, 1923 resulting from an accident of the nature referred to in subsection (1) of section 140 and for this purpose, the said provisions shall, with necessary modifications, be deemed to form part of that Act. Section 144 - Overriding effect The provisions of this Chapter shall have effect notwithstanding anything contained in any other provision of this Act or of any other law for the time being in force.

Motor Vehicles Act, 1988 Section 142

Title: Permanent Disablement

For the purposes of this Chapter, permanent disablement of a person shall be deemed to have resulted from an accident of the nature referred to in sub-section (1) of section 140 if such person has suffered by reason of the accident, any injury or injuries involving:- (a) permanent privation of the sight of either eye or the hearing of either ear, or privation of any member or joint; or (b) destruction or permanent impairing of the powers of any member or joint; or (c) permanent disfiguration of the head or face.
