.....of the provisions of the 1981 Act to the corporation, the Government may, by notification, make such adaptations and modifications of the 1981 Act and the Rules and bye-laws made thereunder, whether by way of repealing, amending or suspending any provision thereof, as may be necessary or expedient and thereupon, the 1981 Act and the Rules made thereunder, shall apply to the corporation subject to the adaptations and modifications so made. (3) Notwithstanding that no provision or insufficient provision has been made under sub-section (2) for the adaptation of the provisions of the 1981 Act, or the Rules and bye-laws made thereunder, any Court, Tribunal or Authority required or empowered to enforce these provisions may, for the purpose of facilitating their application to the corporation, construe these provisions in such manner, without affecting the substance, as may be necessary or proper having regard to the matter before the Court, Tribunal or Authority. .....LIMITED (NATIONALISATION) ACT, 1980 STATEMENT 0F OBJECTS AND REASONS The Hind Cycles Limited and Sen-Raleigh Limited have been engaged in the manufacture and production of bicycles and their component parts and accessories for more than two decades and they have developed a good brand image and adequate consumer acceptance for their products. These two companies account for a total annual capacity of more than ten lakhs of bicycles. However, as there had been a steady fall in production and the companies continued to incur cash losses the management of the two units of Hind Cycles Umited and Sen-Raleigh Limited, along with its associate and subsidiary units, was taken over by the Central Government under the provisions of the Industries (Development and Regulation) Act, 1951, in January. 1974 and September, 1975 respectively. 2. Though nationalised banks and public financial institutions have been advancing large amounts of money, the companies were facing acute shortage of liquid funds for their working capital requirements.
