THE SIKKIM PUBLIC WORKS (LIABILITY OF GOVERNMENT & CONTRACTOR) ACT, 1983 THE SIKKIM PUBLIC WORKS (LIABILITY OF GOVERNMENT & CONTRACTOR) ACT, 1983 (ACT NO. II OF 1983) [1.10.83] AN ACT to provide for liability of the Government and the contractor for certain damage caused to the property in the course of executing a public work and for matters connected therewith. Be it enacted by the Legislature of Sikkim in the Thirty-fourth Year of the Republic of India as follows: Short title, extent and commencement. 1. (1) This Act may be called the Sikkim Public Works (Liability of Government and Contractor) Act, 1983. (2) It extends to the whole of Sikkim. (3) It shall come into force on such date as the State Government may, by notification, appoint. Definition. 2. In this Act, unless the context otherwise requires, (I) "avoidable damage" means cutting of trees, standing crops, damage to huts, camping or dumping materials on the land of another person .without the authority of the owner of the said land and includes any other damage which, in the opinion of the Government, is not an unavoidable damage; 3.
