Indian Telegraph Act, 1885 (13 of 1885) Section 26

Title: Telegraph Officer or Other Official Making Away with or Altering, or Unlawfully Intercepting or Disclosing, Messages, or Divulging Purport of Signals

If any telegraph officer, or any person, not being a telegraph officer but having official duties connected with any office which is used as a telegraph office,-- (a) wilfully secrets, makes away with or alters any message which he has received for transmission or delivery, or (b) wilfully, and otherwise than in obedience to an order of the Central Government or of a State Government, or of an officer specially authorised1[by the Central or a State Government] to make the order, omits to transmit or intercepts or detains, any message or any part thereof, or otherwise than in pursuance of his official duty or in obedience to the direction of a competent court, discloses the contents or any part of the contents of any message, to any person not entitled to receive the same, or (c) divulges the purport of any telegraphic signal to any person not entitled to become acquainted with the same, he shall be punished with imprisonment for a term which may extend to three years or with fine, or with both. _____________________ 1. .....it enacted by Parliament in the Thirty-second Year of the Republic of India as follows:- SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Export-Import Bank of India Act, 1981. (2) It extends to the whole of India. (3) It shall come into force on such date1as the Central Government may, by notification in the Office of this Act in the Official Gazette, appoint, and different dates may be appointed for different provisions SECTION 02: DEFINITIONS. State Bank of India Subsidiary Banks Act, 1959 Section 52

Title: Obligation as to Fidelity Andsecrecy

(1) A subsidiary bank shall observe, except as otherwise required by law, the practices and usages customary among bankers, and in particular, it shall not divulge any information relating to, or to the affairs of its constituents except in circumstances in which it is, in accordance with the law or practice and usage customary among bankers, necessary or appropriate for that bank to divulge such information. (2) Every director, auditor, adviser officer or other employee of a subsidiary bank shall, before entering upon his duties, make a declaration of fidelity and secrecy as in the form set out in the Second Schedule: 1"(3) Nothing contained in this section shall apply to the credit information disclosed under the Credit Information Companies (Regulation) Act, 2005.". Provided that any declaration made under sub-section (2) of section 35 of the State Bank of Hyderabad Act shall be deemed to be declaration made to the Hyderabad Bank under this sub-section. _____________________________ 1.
